  • do prohibit any Goods or Commodities to be imported into or exported out of any Britifh Colony or

' Plantation in America, in any foreign Ship or Veflel ;' To which End therefore, Be it enacted by the Authority aforefaid, That from and after the twenty-ninth Day of September, one thoufand feven Fol 'e!gn Veflels found at hundred and fixty-four, if any foreign Ship or Veflel whatfoever {hall be found at Anchor, or ho-f^^ 1 ^™ 2 ^ vering within two Leagues of the Shore_ ot any Land, Ifland, Plantation, Colony, Territory, or Bricim American Domi- Place, which fhall or may be in the Poffeffion or under the Dominion of his Majefty, his Heirs or nions, Succeflbrs, in America, and fhall not depart from the Coaft, and proceed upon her Voyage to fome and not departing, unlefs foreign Port or Place, within forty-eight Hours after the Mafter or other Perfon taking the Charge diftrefiid, within 48 of fuch Ship or Veffel fhall be required fo to do by any Officer of his Majefty's Cuftoms, unlefs j n Hours alter Notice, cafe of unavoidable Neceffity and Diftrefs of Weather, fuch Ship or Veflel, with all the Goodj therein laden, fhall be forfeked and loft, whether Bulk fhall have been broken or not; and fhall and are liable to be forfeited, may be feized and profecuted by any Officer of his Majefty's Cuftoms, in fuch Manner and Form ^together with the Goods, herein after is exprefied. XXXIV. Provided always, That nothing herein contained fhall extend, or be confirmed ro ex- tend, to any Ship or Veflel belonging to the Subjects of the French King, which fhall be found Except French Filing fifhing, and not carrying on any illicit Trade, on that Part of the Ifland of Newfoundland which J^Jp oft Newfound- ftretches from the Place called Gape Bonav'fta to the Northern Point of the faid Ifland, and from thence running down to the Weftern Side, reaches as far as the Place called Point Riche. XXXV. And, to prevent the concealing any Goods in falfe Packages, or private Places; on feits alr ° trebIe Value, board any Ship or Veflel arriving at any of the Britijh Colonies or Plantations in America, with in- tent to their being clandeftinely landed there, Be it further enacted by the Authority aforefaid, That Concealed Goods found from and after the twenty-ninth Day of September one thoufand feven hundred and fixty-four, all 0n Board, afrer Repcn Goods which fhall be found concealed in any Place whatfoever on board any fuch Ship or Veflel, at made ^ the Mafter > any Time after the Mafter thereof fhall have made his Report to the Collector or other proper Of- ficer of the Cuftoms, and which fhall not be comprized or mentioned in the faid Report, fhall be and not "mprifed in his forfeited and loft, and fhall and may be feized and profecuted by any Officer of the Cuftoms; and Report ' are forfeited > the Mafter or other Perfon having the Charge or Command of fuch Ship or Veflel (in cafe it can be and the Mafter, being made appear, that he was any wife contenting or privy to fuch Fraud or Concealment} fhall forfeit fei^Keble th^v ^ e'"* treble the Value of the Goods fo found. XXXVII. And it is hereby further enacted by the Authority aforefaid, That from and after the twenty-ninth Day of September one thoufand feven hundred and fixty-four, if any Goods or Mer- J f cuftoraed Goods beei- chandizes whatfoever, liable to the Payment of Duties in any Britijh Colony or Plantation in America ^^1%"°^ ^Duties by this or any other Act of Parliament, fhall be loaden on board any Ship or Veflel outward bound, are p^ or fhall be unfhipped or landed from any Ship or VefTel inward bound, before the refpective Duties due thereon are paid, agreeable to Law; or if any prohibited Goods whatfoever fhall be imported ? r prohibited Goods be into, or exported out of, any of the faid Colonies or Plantations, contrary to the true Intent and '^ed'ott^f 'a" of "ch Meaning of this or any other Act of Parliament; every Perfon who fhall be affifting, or otherwife Britifh Colonies'™ A- ? concerned, either in the loading outwards, or in the unfhipping or landing inwards, fuch Goods, ormerioa, ■to whofe Hands the fame fhall knowingly come after the loading or unfhipping thereof, fhall, for each and every Offence forfeit treble the Value of fuch Goods, to be eftimated and computed ac- lhe Perfons concerned cording to the beft Price that each refpective Commodity bears at the Place where fuch Offence was tb erem forfeit treble the committed; and all the Boats, Horfes, Cattle, and other Carriages whatfoever, made ufe of in the a ae , ' loading, landing, removing, Carriage, or Conveyance, of any of the aforefaid Goods, fhall alfo be c a ' ria " s Wl an( | Catde' 5 ' forfeited and loft, and fhall and may be feized and profecuted, by any Officer of his Majefty's employed! And it is hereby further enacted by the Authority aforefaid, That from and after the officer receiving any twenty-ninth Day of September one thoufand feven hundred and fixty-four, if any Officer of his Ma- Bllbej &c- jetty's Cuftoms fhall, directly or indirectly, take or receive any Bribe, Recompence, or Reward, in any Kind whatfoever ; or connive at 2ny falfe Entry, or make any colluiive Seizure or Agreement ; conniving at a fotfe or do any other Act or Deed whatfoever by which his Majefty, his Heirs or Succeflbrs, fhall or may Em ,7 > „ , « .
