Law, Infants beingcinly Truf- tees, ov Mortgagees, may be compelled by fuch Order, to- make iich Conveyances and Afiurances accordingly,. CAP. XVI. An Act to enable Infants who are feifed of Lands, Tenements, or Hereditaments,, within the Duchy of Lancafter, or the Counties Palatine of Chefter, Lancafter, or Durham, or the Principality of Wales, in Fee, or for the- Life or Lives of one or more other Perfon or Perfons, in Truft, or by way of Mortgage, to make Conveyances of fuch Eftates by Order of the Court of the Duchy Chamber of Lancafter, of the Court of Exchequer of the County Palatine of Chefter, the Court of Chancery of the County Palatine of Lancafter, of the Court of Chancery of the County Palatine of Durham, and of the Courts of the Great Seffions in the Principality of Wales. HERE AS by an Aft of Parliament made in the feventh Year of the Reign of her late Majefty Queen Anne, intituled, An Aft to enable Infants ivho are fifed or pofteffed of Eftates. ' in Fee, in Truft, or by way of Mortgage, to make Conveyances of fuch Eftates, Perfons under the Age ' of one and twenty Years, having Eftates in Lands, Tenements, or Hereditaments, only in Trufif ' for others, or by way of Mortgage, are enabled and compellable, by the Direction and Order of ' the High Court of Chancery, or the Court of Exchequer, to convey and affure fuch Lands, Tene- ments, or Hereditaments, in fuch manner as the faid Court of Chancery, or the Court of Exchequer,. 1 {hall, by fuch Order in purfuance of the faid Aft, direft : And whereas the Benefit intended by; ' the faid Aft will be manifeftly extended, by giving to, and verting in, the proper refpeftive Courts- ' of the Duchy of Lancafter, and the Courts in the feveral Counties Palatine of Chejler, Lancafer, ' and Durham, and the Courts of the Great Seffions in Wales, fuch and the like Power, Jurif- ' diftion, and Authority, refpefting Infants who are or fhall be feifed of Lands, Tenements, orr ' Hereditaments, within the faid Duchy of Lancafter, and the feveral Counties Palatine of Chefter,. ' Lancafter, and Durham, and the Principality of Wales refpeftively, in Fee, or for the Life or ' Lives of one or more other Perfon or Perfons, as by the faid Aft is given to, and vefted in, the ' High Court of Chancery, and the Court of Exchequer :' Be it therefore enafted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the firft Day oljune one thoufand feven hundred and iixty-four, it fhall and may be lawful to and for any Perfon or Perfons under the Age of one and twenty Years, having fuch Eftate or Eftatea in Lands, Tenements, or Hereditaments, within the Duchy of Lancafer, or the Counties Palatine of Chejler, Lancafer, and Durham refpeftively, or in the Principality of Wales, by the Direftion o£ the Court of the Duchy Chamber of Lancafter, of the Court of Exchequer of the County Palatine of; Chefter, of the Court of Chancery of the County Palatine of Lancajler, of the Court of Chancery o£ the County Palatine of Durham, and of the feveral Courts of the Great Seffions in Wales refpec-i tively, fignified by an Order made upon hearing all Parties, concerned on the Petition or Motion o£ the Perfon or Perfons for whom fuch Infant or Infants fhall be fo feifed as aforafaid,. in Truft, or of the Mortgagor or Mortgagors, or Guardian or Guardians, of fuch Infant or Infants, or Perfons in- titled to the Monies fecured by or upon any fuch Lands, Tenements, or Hereditaments, whereof any Infant or Infants are or fhall be feifed, in Truft, or by way of Mortgage, or of the Perfon or Perfons intitled to the Redemption thereof, to "convey and affure any fuch Lands,. Tenements, or- Hereditaments, in fuch manner as the faid feveral Courts of the fajd Duchy, Counties Palatine, and Great Seffion in Wales, wherein fuch Lands, Tenements, or Hereditaments, fhall lie, by. fuch-. Order fo to be obtained, direft, to any other Perfon or Perfons ; and fuch Conveyance or Affu- r.mce fo to be had and made as aforefaid, fhall be as good and effeftual in Law, to all- Intents and- Purpofes whatfoever, as if the fai-d Infant or Infants was or were at the Time of making fuch Con-, veyance or Affurance of the full Age of one and twenty Years ; any Lav/, Cuftomj or Ufage, to the contrary in any wife notwithftanding. . . II. And be it further enafted by the Authority aforefaid,. That all and every fuch- Infant or In-, fants, being only Truftee or Truftees, Mortgagee or Mortgagees, as aforefaid, fhall and may be : compelled, by fuch Order as aforefaid to be obtained, to make fuch Conveyance or Conveyances,. Affurance or Affurances, as aforefaid, in like manner as Truftees or Mortgagees of full Age are- compellable to convey or affign their Truft Eftates or Mortgages. C A P.
