Claufes in the Malt Aft of this Seflion relating to the circulating Ex- chequer Bills, in due Courfe or Order of Payment, before the faid fifth Day of April one thoufand feven hundred and fixty-fix; nor fhall any inch Receiver or Collector exchange, at any Time before the faid fifth Day of April one thoufand feven hundred and fixty-fix, for any Money of fuch Revenues, Aids, Taxes or Supplies, in his Hands, any Exchequer Bill or Bills which fhall have been iffued as afore- faid by virtue of this Act ; nor fhall any Action be maintained. againft any fuch Receiver or Col- lector, for neglecting or refufing to exchange any fuch Bill or Bills for ready Money before the faid fifth Day of April one thoufand feven hundred and fixty-fix ; any thing in the faid Act made in this prefent Seflion of Parliament, intituled, An Ail for continuing and granting to his Majefty certain Du- ties upon Malt, Mum, Cycler and Perry for the Service of the Tear one thoufand feven hundred andfixty- four, or this Act contained to the contrary notwithstanding. V. And be it further enacted by the Authority aforefaid, That all fuch Exchequer Bills, toge- ther with the Intereft and Charges incident to or attending the fame, fhall be and are hereby charged and chargeable upon, and fhall be repaid or borne by or out of the firft Aids or Supplies which fhall be granted by Parliament for the Service of the Year one thoufand feven hundred and fixty- fix ; and in cafe fufHcient Aids or Supplies for that Purpofe fhall not be granted before the fifth Day of April one thoufand {even hundred and fixty-fix, then all the faid Exchequer Bills, with the In- tereft and Charges incident to or attending the fame, fhall be and are hereby charged and chargeable upon fuch Monies as, at any Time or Times at or after the faid fifth Day of April, fhall be or re- . main in the Receipt of the Exchequer, of the Surpluffes, ExcefTes, Overplus Monies, and other Revenues compofing the Fund commonly called The Sinking Fund (except fuch Monies of the faid Sinking Fund as fhall then be appropriated to any particular Ufe or Ufes by any Act or Acts., of Parliament in that Behalf) ; and fuch Monies of the faid Sinking Fund fhall and may be iffued and applied, as foon as the fame can be regularly dated and afcertained, for and towards paying off", cancelling and difchargirig fuch Exchequer Bills, Intereft and Charges, until the Whole of them fhall be paid off", cancelled and difcharged, or Money fufHcient for that Purpofe be kept and referved in the Exchequer, to be payable on Demand to the refpective Proprietors thereof. VI. Provided always, and be it enacted by the Authority aforefaid, That whatever Monies fhall be fo iffued out of the faid Surpluffes, ExcefTes, Overplus Monies, or other Revenues compofing the Sinking Fund, fhall from time to time be replaced by and out of the firft Supplies to- be then after granted in Parliament ; any thing herein contained to the contrary notwith- ftanding, VII. And it is hereby further enacted by the Authority aforefaid, That the faid Governor and' Company of the Bank of England, and their Succeffors, fhall and are hereby required to exchange- for ready Money, from time to time, all fuch of the faid Exchequer Bills as fhall, at any Time or Times before the faid fifth Day of April one thoufand feven hundred and fixty-fix, be tendered or produced to them, or their Cafhier or Cafhiers, for that Purpofe, by any Perfon orPerfons; and fhall pay or caufe to be paid to fuch Perfon or Perfons, in ready Money, the Sum for which every fuch Bill, fo tendered or produced, was iffued, together with the Intereft, after the faid Rate of three Pounds per Centum per Annum, which fhall be then due thereupon ; and fhall exchange in Manner as aforefaid, fuch of the faid Bills as fhall have been, from time to time, paid away or cir- culated by or on the Behalf of the faid Governor and Company, or their Succeffors, and fhall be- fore the faid fifth Day of April one thoufand feven hundred and fixty-fix be tendered or produced. as aforefaid, as often as fuch Cafe fhall happen ; and the faid Governor and Company, or their Succeffors, or their Agents or Servants, fhall not be intitled to or receive any Premium, Rate or Allowance whatfoever, for or in refpect of the exchanging or circulating the faid Exchequer Bills ; any Thing herein or in any other Act of Parliament to the contrary not- withftanding. VII 1 .. And be it further enacted by the Authority aforefaid, That in Cafe the faid Governor and Company of the Bank of England, or their Succeffors, or their Cafhier or Cafhiers, fhall neglect or refufe to exchange any fuch Exchequer Bill or Bills for ready Money as aforefaid, contrary to the true Intent and Meaning of this Act, upon Demand thereof made at their Chief'Office within the City of London, for the Space of twenty-four Hours, then the Perfon or Perfons demanding the fame, or the Perfon or Perfons for and on whofe Behalf fuch Demand fhall be made, fhall and may- recover fuch Money to his, her or their own Ufe, by Action of Debt or upon the Cafe, Bill, Suit, or Information, in any of his Majefty's Courts of Record at Weflminfter, wherein no Effoin, Pro- tection, Privilege, or Wager of Law fhall be allowed, or any more than one Imparlance; in which Action, Bill, Suit or Information, it fhall be lawful to declare, that the faid Governor and Com- pany, or their Succeffors, are indebted to the Plaintiff or Plaintiffs, the Money demanded upoa the faid Bill or Bills, according to the Form of this Statute, and have not paid the fame; which fhall be fufHcient; and the Plaintiff or Plaintiffs in fuch Action, Bill, Suit or Information, fhall re- cover againft the faid Governor and Company, and their Succeffors, not only the Money fo ne- glected or refufed to be paid, but alio Damages after the Rate of fifteen VonnAs per Centum per An- num, on fuch Money, together with full Cofts of Suit; and the faid Governor and Company, and their Succeffors, and their faid Stock and Funds fhall be and are hereby made fubject and liable thereunto. IX. And be it further enacted by the Authority aforefaid, That the Claufes, Powers and Provi- fior.s, in the faid AS, made in this prefent Seflion of Parliament, intituled, An Ac! for continuing and granting to his Majefty certain Duties upon Malt, Mum, Cyder and Perry, for the Service of the Tear 1 one
