  • conveniencies that might otherwife happen by Means of fuch Omiffions,' Be it enacted by the

King's moft Excellent Majefty, by and with the Advice and Content of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That all and every Perfon or Perfons, who fhall, on or before the twenty-eighth Day of November one thoufand feven hundred and fixty-four, take and fubferibe the faid Oaths and Affurance refpec- tivcly, in fuch Cafes wherein by Law the faid Oaths and Affurance ought to have been taken or fubferibed in fuch Manner and Form, and fuch Place and Places, as are appointed in and by the laid Act made in the firft Year of the Reign of his faid late Majefty King George the Firft, or by any other Act or Acts of Parliament in that Behalf made and provided; and alfo receive the Sacra- ment of the Lords Supper, according to the Ufa ge of the Church of England, and make and fub- feribe the faid Declaration againft Tranfubftantiation, in fuch Cafes wherein the faid Sacrament ought to have been received, and the faid Declaration ought to have been made and fubferibed; and take and fubferibe the Oath directed by the faid Act made in the eighteenth Year of the Reign of his late Majefty King George the Second, in fuch Cafes wherein the faid Oath ought to have been taken and fubferibed, in fuch Manner as by the faid Act is directed ; and alfo, being a Deputy Lieutenant or Officer of the Militia, fhall on or before the firft Day of Auguft one thoufand feven hundred and fixty-four, leave his Qualification in Writing with the Clerk of the Peace, with whom he is, by the faid Act made in the fecond Year of his prefent Majefty's Reign, required to leave the fame; fhall be and are hereby indemnified, freed and difcharged, from and againft all Penalties,, Forfeitures, Incapacities and Difabilities, incurred or to be incurred, for or by reafon of any for- mer Neglect or Omiffion of taking or fubferibing the faid Oaths or Affurance, or receiving the Sa- crament, or making or fubferibing the faid Declarations, or taking and fubferibing the faid Oath, or leaving his Qualification in Writing with the Clerk of the Peace reflectively, according to the above-mentioned Acts, or any of them, or any other Ait or Acts, is and are and -fhall be fully and actually recapacitated and reftored to the fame State and Condition as fuch Perfon or Perfons were before fuch Negledt or Omiffion, and fhall be deemed and adjudged to have duly qualified him, her or themfelves, according to the above-mentioned Acts, and every of them; and that all Acts done or to be done by any fuch Perfon or Perfons, or by Authority derived from him, her or them, are and fhall be of the fame Force and Validity, as the fame or any of them would have been, if fuch Perfon or Perfons refpectively had taken the faid Oaths or Affurance, and received the Sacra- ment of the Lord's Supper, and made and fubferibed the faid Declaration, and taken and fubferibed the faid Oath, and left his Qualification in Writing with the Clerk of the Peace, according to the Direction of the faid Acts, and every of them ; and that fuch Perfon or Perfons qualifying them- felves in Manner, and within the Time, appointed by this Act, fhall be to all Intents and Pur- pofes as effectual, as if fuch Perfon or Perfons had refpectively taken the faid Oaths and Affurance,. and received the Sacrament, and made and fubferibed the faid Declaration, and taken and fub- feribed the faid Oath, and left his Qualification in Writing with the Clerk of the Peace within the- Time, and in the Manner appointed by the feveral Acts before mentioned. II. Provided always, That this Act, or any Thing herein contained, fhall not extend or be con- conftrued to extend to reftore or inti tie any Perfon or Perfons to any Office or Employment, Be- nefice, Matter or Thing whatfoever, already actually avoided by Judgment of any of his Majefty's- Courts of Record, already filled up or enjoyed by any other Perfon ; but fuch Office, Employ- ment, Benefice, Matter or Thing fo avoided or filled up and enjoyed, fhall be and remain in and-. to the Perfon or Perfons who is or are now intitled to the fame, as if this Act had never been, made. III. Provided alfo, 7'hat this Act, or any Thing herein contained, fliall not extend or be con- ftrued to extend to indemnify any Perfon againft whom final Judgment fhall have been given in. any Action, of Debt, Bill, Plaint or Information in any of his Majefty's Courtsof Record, for any* Penalty incurred by having neglected to qualify himfelf within the Time limited by Law, or any Perfon who fhalL have omitted to qualify himfelf within the Time limited by any Act or Acts of Parliament made during the Reign of his late Majefty King George the Second, for indemnifying; Perfons who have omitted to qualify themfelves for Offices and Employments.

  • IV. And whereas Admiffions of divers Members and Officers of Cities, Corporations and Bo-

' rough Towns, which by feveral Acts of Parliament are directed and required to be ftamped, may

  • not have been provided, or the fame not duly ftamped, or may have been loft or miflaid ;' Be it;

further enacted by the Authority aforefaid, That for the Relief of fuch Perfons whole Admiffionsi may not have been provided, or not duly ftamped as aforefaid, or where the fame have been loft or miflaid, it fhall and may be lawful to and for fuch Perfons, on or before the faid twenty-eighth Day of November one thoufand feven hundred and fixty-four, to provide or caufe to be provided, Admif- fions duly ftamped, and fuch Perfons fo providing Admiffions duly ftamped as aforefaid, are and' fhall be hereby confirmed and qualified to act as Member or Members, Officer or Officers of fuch.' Cities, Corporations and Borough Towns refpectively, to all Intents and Purpofes, and fhall and' may hold, enjoy and execute the fame, or any other Office or Offices into which he or they hath or have been elected, notwithftanding his or their Omiffion, or the Omiffion of any of their Prede- ceffors in fuch Cities, Corporations, or Borough Towns as aforefaid, and fliall be indemnified and* difcharged of and from all.
