[S.], of Tarbat, s. I 1 703. an<1 k- of Sir John M., 1st Bart. [S.] of the same, by Margaret, da. and coheir of Sir George Ebskine, of Innerteil, was b. 1630, sue. his father in the Baronetcy and estates, 10 Sep. 1654, in which year he raised a force to attempt the King's restoration, and maintained it a year, when he was forced to an honourable capitulation. On 1 June 1661 he was made a Lord of Session [S.], but was deprived thereof under the administration of Lauderdale. On 16 Oct. 1678 ho became Justice General [S ], and, on his resignation thereof, in 1 681. Lord Clerk Register [S.], and again a Lord of Session [S.], having thenceforth the chief manage- ment of Scottish affairs till the deposition of James II, by whom, on 15 April 1685, he was er. VISCOUNT OF TARBAT, LORD MACLEOD AND CASTLEHAVEN [S.] By William III he was not at first employed, but in 1692 was restored as Lord Clerk Register [S.], which he resigned in 1696. By Queen Anne he was cr., 1 Jan. 1702/3 (being her fin* creation of a Scottish Peer), EARL OF CROMARTY, VIS- COUNT OF TARBAT, LORD MACLEOD AND CASTLEHAVEN [S.], " sibi ct htercdibus suis masculis ct latluc,"^) and was appointed one of the principal Secretaries of State in April 1703, which office he resigned next year for the easier one of Lord Justice General [S.], an office he also resigned in 1710. He was a zealous promoter of the Union [S.], not only by votes and speeches, but by his writings, which were some- what numerous. He was an orig. fellow of the Royal Society. (•') He m. firstly Ann, da. of Sir James Sinclair, Bart. [S.], of Mey, by Elizabeth, da. of Patrick (Leslie), 1st Lord Lindores [S.] He m. secondly, 11 April 1700 (Cramond register), Margaret, sua jure Countess of Wkmtss [I.], widow of James (Wemyss), Lord Burtisland [S.] She d. 1705. He d. 17 Aug. 17H, in his 84th year, at New Tarbat. II. 1714. 2. John (Mackenzie), Earl of Crojiarty, &c. [S.], s. and h. by 1st wife ; was M.P. for co. Ross in 16S5, when it was resolved that " by reason his father was nobilitate," he could not represent that shire. He wan tried April 1691, before the Court of Justiciary, for the murder of the Sieur de la Roche, but was acquitted. He m. firstly, 1685, Elizabeth, da. of Charles (Gordon), 1st Earl of Aboyne [Sj, by Elizabeth, da. of John (Lyon), Earl of Kinohorn [S.] She d. B .p. He m. secondly, 25 April 1701, Mary, da. of Patrick (») " If the word et be read, a B in the Polwarth case, as equivalent to whom failing, then the grant was to Viscount Tarbat and his heirs male, whom failing to his heirs of entail; but, as no special entail is mentioned, the words aa to the entail might probably be held to be too uncertain to create a valid destination. Lord Cromarty held several different estates, and the entail affecting each of them might be different." See "Hewlett," p. 131.
