He d. about 1500, certainly before 1511/2. II. 1500? 2. Joiin (Hay), Lord Hay of Yester [S.], s. and h., by first wife, sue. to the peerage [S-] about 1500. He m. Elizabeth Crichton, probably of the house of Sanquhar. He d. 9 Sep. 1513, being slain at the battle of Flodden. Ilis widow living 1510. III. 1513. J. JOHN (Hay), Lord Hay op Yester [§.], s. and h., who sue. to the peerage [S.], Sep. 1513. Hu set his seal to a treaty with England, 7 Oct. 1517. He m. firstly, in or before Oct. 1509, Elizabeth, sister of Archibald, 8th Earl of Angus [S.], da. o£ George Dscolas, Master of Angus, by Elizabeth, da. of John (Drummond), 1st Lord DromMOXD [S.J He m. secondly ( — ), da. and h. of ( — ) Dickson, of Smithfield, co. Peubles.( a ) He d. 1543. IV. 1543. 4- JonN (Hay), Lord Hay of Yester [S.], s. and h., by first wife, sue. to the peerage [S-], 1513. He was taken prisoner at the battle of Pinkie, 10 Sep. 1547, and sent to the Tower of London till peace was established. He tn. before Oct. 1533, Margaret, 1st da. of William (Livingston), 4th Lord Livingston [S.], by Agnes, da. of Adam Hepburn. He d. 1557. V. 1557. 5. William (Hay), Lord Hay of Yester [S.], sue, to (lie peerage [SO 1557 and was served heir to his father 1559. Ho m. in or before Sep. 1560, Margaret, da. of Sir John Kerr, of Fernihirst, by Catharine, da. of Sir Andrew Kerr, of Cessford. He d. Aug. 1576. YI. 157G. 6. William (Hay), Lord Hay of Yester [S.], s. and h., sue- to the peerage [S.] in Aug. 1576 and was served heir to his father in Oct. following. In 15S2 he was one of the detainers of the King [S.] in Ruthven Castle but was pardoned in 15S5. He resigned his lauds and dignities in Feb. 1590/1, and obtained a charter thereof limiting them to heirs male'^) but d, before his re-infeftmeut therein. He m. Mary, da. of John (Maxwell), Lord Heruiks [S.], by Agnes, suo jure Baroness Herries of Terregles [S.] She was living Feb. 1590/1. He d. s.p.m. early in 1591. VII. 1591. % James (Hay), Loud Hay of Yester [8.], br. and h. male, who received from the King a charter, 29 May 1591, of the Lordship and Barony of Yester with a seat and vote in Pari, and all other honours and dignities enjoyed by the abovenamed William and his predecessors in the same way as if he had inherited them as heir male of entail. He m. in or before Sep. 1594 Margaret, da. of Mark (Kerr), 1st Earl of Lothian [S.], by Margaret (sister of Mary, Baroness Hay of Yester [S.] abovenamed), da. of John (Maxwell), Lord Herries [S.] He d. Feb. 1609. His widow HI. Sir Andrew Kerr, Master of Jedburgh, who d. s.p. 20 Dec. 1628. She, who founded " Lady Yester's church" in Edinburgh, d 15 March 1647, aged 75. VIII. 1609. S. John (Hay), Lord ILvy of Yester [S.J s. and h., sue. to the peerage [S.], in Feb. 1609, and was cr. 1 Dec. 1646, EARL OF TWEEDALE [S.] See that dignity. (") By her he had a son, John, ancestor of the family of Hay, of SmithBeld Baronets. ( b ) He had six daughters and " this charter contains a clause for the exoneration of the conscience of the said William, Lord Hay of Yester, in excluding the daughters and heirs female from their birthright that, if lie should die without issue male, his brother should pay 10,000 marks to his elder da., 7,000 marks to the second, and 6,000 marks to each of tlio younger daughters."
