UR SOVERAIGN LORD confidering the great prejudice , which this Kingdom doth Main by the fumptuoufnefs and prodigality which all forts of perfons ufe in their Apparel , without regard to, or diitinftion of, their feveral degrees and qualities ; confiderable fummes of money being, upon that occafi- on, unneceflarly exported out of the Kingdom, and the Native Commodities and Manufactories thereof being thereby neglected , and not improven for the ufe and advantage of the Inhabitants : For remeid where- of, His Majefty, with ad vice and confent of His Eftates of Parliament, Statutes and Ordains, that none of His Majefties Subjects of this Kingdom,of whatfoever degree, condition or quality, mail, after thefirft day ctjune.onc thoufand.fix hundred,threefcore thirteen Years,wear any Cloths or Apparel wherein there is any Gold or Silver ■ or wear any Gold or Silver Laces of whatfoever kind, Buttons, Ribbands, Tracings, Fringes, or Louping made of Gold or Silver ; or have any Imbroideringof Gold or Silver upon their Apparel , Sword-ij belts or any other manner of way : Excepting alwayes Buttons,Buckles and Hilts of Swords of Gold-fmith- Avork, which the Priviledged Perfons after-expreft are allowed to wear, and no others: And thatnorte!|| wear any Flowred Stuffs, Stripped ftufFs, or Brocado's of Silk, or have any Silk-lace, Gimp lace, or any other* kind of Lace or Imbroidering of Silk upon their wearing Cloathes : And that no perfon prefume to import in- j ( to this Kingdom , or make, or fell therein any of the Commodities ahove-expreft alter the date hereof; 1 Certifying fuch as fhall contraveen , that they mall be lyable in the pains following , viz. The Importer , i Maker and Seller , fhall befyned in One thoufand pounds Scots , by and attour the Confifcation of die Goodsi ( fo imported, made or fold: And the Wearer thereof in five hundred merks Scots , toties quoties , by and j attour the Confifcation of the Cloathes. And it is hereby Declared, that the Importer of fuch prohibited ^ Goods fhall not have Action, for the price thereof, againft the Merchant, for whofe ufe the fame were import- ] t ed ; Nor the feller thereof againft the Buyer , albeit Bands be given for the fame , if it can be made appear 1 that the Bands were given for that caufe : Excepting alwayes from this prefent Act , Comedians , as to the : » Cloathes which they make ufe of upon the Stage ; Heraulds , as to their Coats , and His Majefties Trumpet- 1 ters; And alfo excepting Pages and Lacqueys ot the Priviledged Perfons after-named, as to filk-laces and 1( Pafments allanerly , which they are hereby allowed to wear upon their Livery- cloathes , And His Majefty , with advice forefaid , Doth Statute and Ordaine , that none of His Subjects fhall , after the flrft of June next* | D wear any Cloathing or Apparel of Velvet , Sattin or other ftufFs of Silk , or wear any Beaver-hats , under the jj pain of five hundred merks , to be payed by the contraveener , toties quoties : Except Noble men , Prelates, His Majefties Counfellors , Lords of Jeffion , and fuch Barrons , Knights, or Gentle-men , who have of yearly valued Rent Two thoufand pounds Scots money; And the Provofts of the principal Burrows within this Kingdom ; Or thefe that have been Provofts , and fuch alfo as fhall be for the time , or have been Provofts, Baillies , Dean of Gild or Theafurer within the Town of Edinburgh -. Excepting alfo Rectors of Univerfities* and the Wives of the faids Priviledged Perfons. their eldeft Sons, and eldeft Daughters unmarried, and all the Children of Noble-men; And that none wear any Ribbands or Louping of Silk upon their Apparel , or any white Lace,, or Point made of Threed , under the pain of Five hundred merks Scots toties quoties; Excep-J ting the Privileged Perfons aforefaid , who are hereby allowed to wear plain Tafiety-ribbands upon their Ap parel , and to wear white Lace or Point made of Threed upon their Linnings only. And all perfons whatfo ever are hereby prohibited to wear Feathers, except Souldiers , under the pain aforefaid : But prejudice aH wayes to all ranks of perfons ( except thofe of the Yeomanry ) to wear plain Tafiety-ribbands upon fuch parts « of their Apparel where they may have occafion of the fame for Tyes; and to Women to wear Hoods and m Skarfs of Taffety : And but prejudice to domeftick fervants to wear their Mafters or Miftreffes old Cloathes , I allowed to them by this Act. And for the better effectuating hereof, His Majefty, with advice forefaid, 1 Ordains all Collectors of Affefsment and Excife , and their Sub- Collectors, Farmorers and Collectors ol 1 Cuftomes, and Waiters in Burgh or Land, at every Term to give up, upon Oath, to the Commiffioners o! « Excife in the feveral Shires and Burghs, and to the General Collectors of the Cuftomes and Excife, Lifts ol h all thofe whom they have feen and obferved to tranfgrefs this Act : And it is hereby Declared , that the one half of the penalties aforefaid lhall belong to themfelves , and the other half fhall be collected by them for His Majefties ufe ; Tryal being firft taken, and the perfons found guilty , by the Commiffioners of Affefsment oi Excife, Juftices of Peace, or other ordinary Magiftrate of the place: And fuch Contraveeners as they fhaf not give information of , that the one h alf of their Fynes fhall belong to any other perfon who fhall difcovei them. And in cafe the faid Collectors of Affefsment and Excife, Farmorers and Collectors of Cuftomes , or Waiters , fhall failzie to give up the faid Lifts as aforefaid, They fhall thereby lofe their places , and be in capable of that Service for ever. It is alwayes provided, that no perfons contraveening this Act, fhall bf liable to the faids penalties , unlefs their names be given up within the fpace of three months after their incur ring thereof : But prejudice alwayes to any other psrfon , who fhall difcover the Contraveeners in mannej forefaid, 1
