or persons so being within such holy orders, and convict of or for any of the offences aforesaid, and delivered to the Ordinary for the same, do find two sufificient sureties by Recognizance before two of the King's Justices of his peace, within the same Shire where the petty treason, murder or felony whereof he was convicted was committed and done, whereof one of them to be of the Quorum, that such Convict shall be of good abearing against the King our Sovereign Lord his Laws and Subjects; every such convict to be bound in the sum of £40, and every his sureties in £20, and that no surety be taken unless such as may dispend in lands tenements or hereditaments yearly, above all charges, of estate of inheritance of chart hold 26s. 8d. or else be worth £20 in movable substance at the time of the taking of such recognizance; and that two Justices of Peace, whereof one to be of the Quorum, by authority aforesaid have power and authority to take such recognizance; And that the said Justices afore whom any such recognizance shall be taken shall certify the same into the King's Bench within four months next after the taking thereof upon pain to lose and forfeit 100s. for every default thereof. And forasmuch as there be no Justices of Peace nor of the Quorum within Wales, nor in divers other Places, Cities Honours Lordships and Manors within the King's Dominion, whereas a Lord Marcher Steward Lieutenant Deputy or other Officer of any such Place City Honour Lordship or Manor have authority and power, by custom or other wise, to arraign afore him or them any such person or persons being within such holy orders of Subdeacon or above, for committing or doing any of the said petty treasons murders felonies or any other of the said offences; And if it happen the same person so being thereof arraigned to be found guilty, for to admit him to his clergy if he pray the same before judgment, and further to do and execute against any such offender being so arraigned before them, in like manner and form as Justices of the Gaol delivery, within the Shire ground, have to do by virtue of the King's Commission unto them directed: By reason whereof every such person or persons within such orders of Subdeacon or above, being convict of any of the said petty treasons murders felonies or any other the said offences, before any Lord Marcher, Steward Lieutenant Deputy or other Officer within Wales, or within any other Place City Honour Lordship or Manor within the King's Dominion where no Justices of Peace be, and thereupon committed unto the Ordinary as clerk
