Sherman Act—Price fixing—Independent adverse foreign effect.—Where price fixing conduct significantly and adversely affects customers outside and within United States, but adverse foreign effect is independent of any adverse domestic effect, exception to Foreign Trade Antitrust Improvements Act of 1982—which excludes from Sherman Act's reach most anticompetitive conduct causing only foreign injury—does not apply, and thus, neither does Sherman Act, to a claim based solely on foreign effect.
