(1) by striking "and" at the end of subparagraph (A); (2) by inserting "and" after the semicolon at the end of subparagraph (B); and (3) by inserting after subparagraph (B) the following subparagraph: "(C) if an endangered species or threatened species of a marine mammal is involved, the taking is authorized pursuant to section 101(a)(5) of the Marine Mammal Protection Act of 1972;"; (4) by striking "and" at the end of clause (ii); (5) by redesignating clause (iii) as clause (iv) and by striking "clause (ii)" in that clause and inserting in lieu thereof "clauses (ii) and (iii)"; and (6) by inserting after clause (ii) the following new clause:
"(iii) in the case of marine mammals, specifies those measures that are necessary to comply with section 101(a)(5) of the Marine Mammal Protection Act of 1972 with regard to such taking, and". (c) EXEMPTIONS.—Subsection (o) of section 7 of the Endangered Species Act of 1973 (16 U.S.C. 1536(o)) is amended— (1) in the matter preceding paragraph (1)— (A) by inserting ", sections 101 and 102 of the Marine Mammal Protection Act of 1972," immediately before "or any regulation"; and (B) by striking "either" and inserting in lieu thereof "any"; and (2) in paragraph (2)— (A) by striking "(b)(4)(iii)" and inserting in lieu thereof "a))(4)(iv)"; and ' (B) by inserting "prohibited" immediately before "taking of the species".
