An Act Nov. 7, 1988 [H.R. 4919] Conservation. 16 USC 1823 note.

To approve the governing international fishery sigreement between the United States and the Union of Soviet Socialist Republics, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SOVIET UNION FISHING AGREEMENT.

That notwithstanding any provision of the Magnuson Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.), the governing international fishery agreement entered into between the Government of the United States and the Government of the Union of Soviet SociaUst Republics, as contained in the message to Congress from the President of the United States dated June 22, 1988, is approved by the Congress and shall enter into force and effect with respect to the United States on the date of the enactment of this Act. SEC. 2. MARINE BIOMEDICAL INSTITUTE.

Appropriation authorization.

There is authorized to be appropriated such sums as may be necessary for the development of a Marine Biomedical Institute for Advanced Studies, to be located at Woods Hole, Massachusetts. SEC. 3. GREAT LAKES MAPPING REAUTHORIZATION.

Section 3206 of Public Law 100-220 is amended by striking "1988", and inserting instead "1989". SEC. 4. STORAGE OF FISHING GEAR ON CERTAIN FOREIGN FISHING VESSELS OPERATING IN THE EXCLUSIVE ECONOMIC ZONE.

Section 307 of the Magnuson Fishery Conservation and Management Act (16 U.S.C. 1857) is amended— (1) in paragraph (2)(C) by striking "and"; (2) by striking the period at the end of paragraph (3) and inserting "; and"; and (3) by adding at the end the following: "(4) for any fishing vessel other than a vessel of the United States to operate, and for the owner or operator of a fishing vessel other than a vessel of the United States to operate such vessel, in the exclusive economic zone, if— "(A) all fishing gear on the vessel is not stored below deck or in an area where it is not normally used, and not readily available, for fishing; or "(B) all fishing gear on the vessel which is not so stored is not secured and covered so as to render it unusable for fishing; unless such vessel is authorized to engage in fishing in the area in which the vessel is operating.".
