PUBLIC LAW 106-398—APPENDIX 114 STAT. 1654A-49 SEC. 253. ENHANCEMENT OF AUTHORITIES REGARDING EDUCATION PARTNERSHIPS FOR PURPOSES OF ENCOURAGING SCI- ENTIFIC STUDY. (a) ASSISTANCE IN SUPPORT OF PARTNERSHIPS. — Subsection (b) of section 2194 of title 10, United States Code, is amended— (1) in the matter preceding paragraph (1), by inserting ", and is encouraged to provide," after "may provide"; (2) in paragraph (1), by inserting before the semicolon the following: "for any purpose and duration in support of such agreement that the director considers appropriate"; and (3) by striking paragraph (2) and inserting the following new paragraph (2): "(2) notwithstanding the provisions of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 471 et seq.) or any provision of law or regulation relating to transfers of surplus property, transferring to the institution any computer equipment, or other scientific equipment, that is— "(A) commonly used by educational institutions; "(B) surplus to the needs of the defense laboratory; and "(C) determined by the director to be appropriate for support of such agreement;". (b) DEFENSE LABORATORY DEFINED. —Subsection (e) of that section is amended to read as follows: "(e) In this section: "(1) The term 'defense laboratory' means any laboratory, product center, test center, depot, training and educational organization, or operational command under the jurisdiction of the Department of Defense. "(2) The term 'local educational agency' has the meaning given such term in section 14101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 8801).". SEC. 254. RECOGNITION OF THOSE INDIVIDUALS INSTRUMENTAL TO NAVAL RESEARCH EFFORTS DURING THE PERIOD FROM BEFORE WORLD WAR II THROUGH THE END OF THE COLD WAR. (a) FINDINGS. —Congress makes the following findings: (1) The contributions of the Nation's scientific community and of science research to the victory of the United States and its allies in World War II resulted in the understanding that science and technology are of critical importance to the future security of the Nation. (2) Academic institutions and oceanographers provided vital support to the Navy and the Marine Corps during World War II. (3) Congress created the Office of Naval Research in the Department of the Navy in 1946 to ensure the availability of resources for research in oceanography and other fields related to the missions of the Navy and Marine Corps. (4) The Office of Naval Research of the Department of the Navy, in addition to its support of naval research within the Federal Government, has also supported the conduct of oceanographic and scientific research through partnerships with educational and scientific institutions throughout the Nation.
