SEC. 1405. TREATMENT UNDER FREEDOM OF INFORMATION ACT OF CERTAIN CONFIDENTIAL INFORMATION SHARED WITH STATE AND LOCAL PERSONNEL.

(a) IN GENERAL.—Chapter 3 of title 10, United States Code, is amended by adding at the end the following new section: ‘‘§ 130d. Treatment under Freedom of Information Act of certain confidential information shared with State and local personnel ‘‘Confidential business information and other sensitive but unclassified homeland security information in the possession of the Department of Defense that is shared, pursuant to section 892 of the Homeland Security Act of 2002 (6 U.S.C. 482), with State and local personnel (as defined in such section) shall not be subject to disclosure under section 552 of title 5 by virtue of the sharing of such information with such personnel.’’. (b) CLERICAL AMENDMENT.—The table of sections at the beginning of such chapter is amended by adding at the end the following new item: ‘‘130d. Treatment under Freedom of Information Act of certain confidential information shared with State and local personnel.’’. 10 USC 113 note.

SEC. 1406. DATABASE OF EMERGENCY RESPONSE CAPABILITIES.

The Secretary of Defense shall maintain a database of emergency response capabilities that includes the following: (1) The types of emergency response capabilities that each State’s National Guard, as reported by the States, may be able to provide in response to a domestic natural or manmade disaster, both to their home States and under State-to-State mutual assistance agreements. (2) The types of emergency response capabilities that the Department of Defense may be able to provide in support of the National Response Plan’s Emergency Support Functions, and identification of the units that provide these capabilities.
