‘‘(A) IN G ENER AL .—E x cept as pro v ided in subparagraph ( B ), the amounts’’; and (2) by adding at the end the following: ‘‘(B) REDISTRIBUTION.— F unds that would be paid to a 1994 Institution under paragraph (2) shall be withheld from that 1994 Institution and redistributed among the other 1994 Institutions if that 1994 Institution— ‘‘(i) declines to accept funds under paragraph (2); or ‘‘(ii) fails to meet the accreditation requirements under section 533(a)(3).’’. (d) INSTITUTIONAL CA P A C IT Y BUILDING GRANTS.—Section 535 of the Equity in Educational Land-Grant Status Act of 1994 (7 U.S.C. 301 note; Public Law 103–382) is amended by striking ‘‘2007’’ each place it appears and inserting ‘‘2012’’. (e) RESEARC H GRANTS.—Section 53 6 (c) of the Equity in Edu- cational Land-Grant Status Act of 1994 (7 U.S.C. 301 note; Public Law 103–382) is amended in the first sentence by striking ‘‘2007’’ and inserting ‘‘2012’’. (f) EFFECTI V E D ATE.—The amendment made by subsection (a) takes effect on O ctober 1, 2008. SEC.7403 .S MITH-L E V E RA CT. (a) PROGRAM.—Section 3(d) of the Smith-Lever Act (7 U.S.C. 343(d)) is amended in the second sentence by striking ‘‘apply for and receive’’ and all that follows through paragraph (2) and inserting ‘‘compete for and receive funds directly from the Secretary of Agriculture.’’. (b) ELIMINATION OF THE GOVERNOR’S REPORT RE Q UIREMENT FOR E X TENSION ACTIVITIES.—Section 5 of the Smith-Lever Act (7 U.S.C. 345) is amended by striking the third sentence. (c) CONFORMING AMENDMENT.—Section 1444(a)(2) of the N ational Agricultural Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3221(a)(2)) is amended by striking ‘‘after September 30, 1995, under section 3(d) of that Act (7 U.S.C. 343(d))’’ and all that follows through the end of the sentence and inserting ‘‘under section 3(d) of that Act (7 U.S.C. 343(d)).’’. SEC. 7404. HATCH ACT OF18 87. (a) DISTRICT OF COLUMBIA.—Section 3(d)(4) of the H atch Act of 1887 (7 U.S.C. 361c(d)(4)) is amended— (1) in the paragraph heading, by inserting ‘‘AND THE DIS- TRICT OF COLUMBIA’’ after ‘‘AREAS’’; (2) in subparagraph (A)— (A) by inserting ‘‘and the District of Columbia’’ after ‘‘United States’’; and 7USC130 1 note.
