SEC.320 3. T EC HNI C AL ASSISTANCE FOR S P ECIALT Y CROPS. S ection 3 20 5 of the F ar m Security and R ural I n v estment Act of 2002 ( 7U .S. C . 5680) is amended by stri k ing subsection (d) and inserting the follo w ing

‘(d) ANNUA L R E PORT.— N ot later than 180 days after the date of enactment of the Food, Conservation, and E nergy Act of 2008 and annually thereafter, the Secretary shall submit to the appro - priate committees of Congress a report that contains, for the period covered by the report, a description of each factor that affects the e x port of specialty crops, including each factor relating to any— ‘‘(1) significant sanitary or phytosanitary issue

or ‘‘(2) trade barrier. ‘‘(e) FUN D IN G .— ‘‘(1) CO M MODIT YC REDIT CORPORATION.—The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out this section. ‘‘(2) FUNDING AMOUNTS.— O f the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section— ‘‘(A) $ 4 ,000,000 for fiscal year 2008; ‘‘( B ) $7,000,000 for fiscal year 200 9

‘‘(C) $8,000,000 for fiscal year 2010; ‘‘( D ) $9,000,000 for fiscal year 2011; and ‘‘(E) $9,000,000 for fiscal year 2012. ’ ’. SEC. 320 4 .E M ER G ING MAR K ETS AN D FACILITY G U ARANTEE LOAN PRO - GRAM. Section 1542 of the Food, Agriculture, Conservation, and Trade Act of 1990 (7 U.S.C. 5622 note; P ublic L aw 101 – 624) is amended— (1) in subsection (a), by striking ‘‘2007’’ and inserting ‘‘2012’’; (2) in subsection (b)— (A) in the first sentence, by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately; (B) by striking ‘‘A portion’’ and inserting the following: ‘‘(1) IN GENERAL.—A portion’’; (C) in the second sentence, by striking ‘‘The Commodity Credit Corporation’’ and inserting the following: ‘‘(2) PRIORITY.—The Commodity Credit Corporation’’; and (D) by adding at the end the following: ‘‘(3) CONSTRUCTION W AI V ER.—The Secretary may waive any applicable re q uirements relating to the use of United States goods in the construction of a proposed facility, if the Secretary determines that— ‘‘(A) goods from the United States are not available; or ‘‘(B) the use of goods from the United States is not practicable. ‘‘(4) TERM OF GUARANTEE.—A facility payment guarantee under this subsection shall be for a term that is not more than the lesser of— ‘‘(A) the term of the depreciation schedule of the facility assisted; or
