‘‘(vi) ALTERNATIVE APPLICATION OF B UDGET-NEU- TRALITY ADJUSTMENT.—Notwithstanding subsection (d)(9)(A), effective for fee schedules established begin- ning with 2009, with respect to the 5-year review of wor k relative value units used in fee schedules for 200 7 and 2008, in lieu of continuing to apply budget- neutrality adjustments re q uired under clause (ii) for 2007 and 2008 to work relative value units, the Sec- retary shall apply such budget-neutrality adjustments to the conversion factor otherwise determined for years beginning with 2009.’’. SEC.134 .E XT E N S IO NO F F L OO R ON M E D IC A RE W OR KG EOGRA PH IC AD JU STMENT UNDER THE MEDICARE PH Y SICIAN FEE SCHEDULE. (a) IN G ENERAL.—Section 1848(e)(1)( E ) of the Social Security Act (42 U.S.C. 1395w–4(e)(1)(E)), as amended by section 103 of the Medicare, Medicaid, and SC H I P E x tension Act of 2007 (Public L aw 110–173), is amended by striking ‘‘before J uly 1, 2008’’ and inserting ‘‘before January 1, 2010’’. (b) TREATMENT OF P H YSICIANS’ SERVICES FURNISHED IN CER- TAIN AREAS.—Section 1848(e)(1)(G) of the Social Security Act (42 U.S.C. 1395w–4(e)(1)(G)) is amended by adding at the end the following new sentence: ‘‘For purposes of payment for services fur- nished in the State described in the preceding sentence on or after January 1, 2009, after calculating the work geographic index in subparagraph (A)(iii), the Secretary shall increase the work geographic index to 1.5 if such index would otherwise be less than 1.5’’. (c) TECHNICAL CORRECTION.—Section 6 02(1) of the Medicare Prescription D rug, Improvement, and Moderni z ation Act of 2003 (Public Law 108–173
117 Stat. 2301) is amended to read as follows: ‘‘(1) in subparagraph (A), by striking ‘subparagraphs (B), (C), and (E)’ and inserting ‘subparagraphs (B), (C), (E), and (G)’; and’’. SEC. 13 5 . IMAGING PRO V ISIONS. (a) ACCREDITATION R E Q UIREMENT.— (1) ACCREDITATION REQUIREMENT.—Section 1834 of the Social Security Act (42 U.S.C. 1395m) is amended by inserting after subsection (d) the following new subsection: ‘‘(e) ACCREDITATION REQUIREMENT FOR ADVANCED DIAGNOSTIC IMAGING SERVICES.— ‘‘(1) IN GENERAL.— ‘‘(A) IN GENERAL.—Beginning with January 1, 2012, with respect to the technical component of advanced diag- nostic imaging services for which payment is made under the fee schedule established under section 1848(b) and Ef f ectiv e da te .42USC1395w– 4.
