(c) N ATIONA L IN S TIT U T E O F ALLER GY AND INFE C TIOUS DIS- EASES.—Subpart 6 of part C of title IV of the Public Health Service Act ( 4 2 U.S.C. 2 85 fetse q .) is amended by adding at the end the following

‘ SEC.4 4 7 C. MI C ROB ICI D E RESE A RC H A N DDE V E L O P MEN T . ‘‘ T he Director of the Institute, acting through the head of the Division of AIDS, shall, consistent with the peer-review process of the National Institutes of Health, carry out research on, and development of, safe and effective methods for use by women to prevent the transmission of the human immunodeficiency virus, which may include microbicides.’’. (d) CDC.—Part B of title III of the Public Health Service Act (42 U.S.C. 243 et seq.) is amended by inserting after section 31 7 S the following: ‘‘SEC. 31 7T. MICROBICIDE RESEARCH. ‘‘(a) IN GENERAL.—The Director of the Centers for Disease Control and Prevention is strongly encouraged to fully implement the Centers’ microbicide agenda to support research and develop- ment of microbicides for use to prevent the transmission of the human immunodeficiency virus. ‘‘(b) AUT H ORI Z ATION OF A P PROPRIATIONS.—There are authorized to be appropriated such sums as may be necessary for each of fiscal years 2 0 0 9 through 2013 to carry out this section.’’. (e) UNITED STATES AGENCY FOR INTERNATIONAL DE V ELOP- M ENT.— (1) IN GENERAL.—The Administrator of the United States Agency for International Development, in coordination with the Coordinator of United States Government Activities to Com- bat HIV/AIDS Globally, may facilitate availability and accessi- bility of microbicides, provided that such pharmaceuticals are approved, tentatively approved, or otherwise authorized for use by— (A) the Food and Drug Administration; (B) a stringent regulatory agency acceptable to the Secretary of Health and Human Services; or (C) a quality assurance mechanism acceptable to the Secretary of Health and Human Services. (2) AUTHORIZATION OF APPROPRIATIONS.—Of the amounts authorized to be appropriated under section 401 of the United States L eadership Against HIV/AIDS, Tuberculosis, and M alaria Act of 2003 (22 U.S.C. 7671) for HIV/AIDS assistance, there are authorized to be appropriated to the President such sums as may be necessary for each of the fiscal years 2009 through 2013 to carry out this subsection. 2 2 USC7631a.4 2 USC 247 b– 22.
