AUTHORIZ ATIO NF OR CA P ITA L AN D PRE V ENTIVE M AINTE - NANCE PRO J ECTS FOR W ASHIN G TON METROPOLITAN AREA TRANSIT AUTHORIT Y . (a)AUTHORIZA TIO N.— ( 1 ) I N GE NERA L .— Subject t o t h e s uccee dingpr o v isions o f this section , the Secretar y of T ransportation is authori z ed to m a k e grants to the Transit Authority, in addition to the con - tributions authorized under sections 3 ,1 4 , and1 7 of the N ationa lC apital Transportation Act of 1 96 9 (sec. 9 – 11 0 1.01 et se q ., D .C. O fficial Code), for the purpose of financing in part the capital and preventive maintenance projects included in the Capital Improvement P rogram approved by the B oard of Directors of the Transit Authority. ( 2 )DE F INITION S .—In this section— (A) the term ‘ ‘Transit Authority ’ ’ means the W ash- ington M etropolitan Area Transit Authority established under Article III of the Compact

and (B) the term ‘‘Compact’’ means the Washington Metro- politan Area Transit Authority Compact ( 8 0 Stat. 1324; Public L a w 89–774). (b) U SE OF F UN D S.—The Federal grants made pursuant to the authorization under this section shall be subject to the following limitations and conditions

(1) The work for which such Federal grants are authorized shall be subject to the provisions of the Compact (consistent with the amendments to the Compact described in subsection (d)). (2) E ach such Federal grant shall be for 5 0 percent of the net project cost of the project involved, and shall be provided in cash from sources other than Federal funds or revenues from the operation of public mass transportation systems. Con- sistent with the terms of the amendment to the Compact described in subsection (d)(1), any funds so provided shall be solely from undistributed cash surpluses, replacement or depre- ciation funds or reserves available in cash, or new capital. (3) Such Federal grants may be used only for the mainte- nance and upkeep of the systems of the Transit Authority as of the date of the enactment of this Act and may not be used to increase the mileage of the rail system. (c) A P PLI C A B ILIT Y OF R E Q UIRE M ENTS FOR MASS TRANSPOR- TATION CAPITAL PRO J ECTS RECEI V ING FUNDS UNDER FEDERAL TRANSPORTATION LA W .—E x cept as specifically provided in this sec- tion, the use of any amounts appropriated pursuant to the authorization under this section shall be subject to the requirements applicable to capital projects for which funds are provided under chapter 53 of title 49, United States Code, except to the extent that the Secretary of Transportation determines that the require- ments are inconsistent with the purposes of this section.
