(d) USE OF F EDERAL F U NDS P ROHI B ITED.—Federal funds may notbeusedtopayanye x pense of the establishment of the commemorative work authorized by subsection (b). The M arion Park Pro j ect, a committee of the Palmetto Conservation Foundation, shall be solely responsible for acceptance of contributions for, and payment of the expenses of, the establishment of that commemora - tive work. (e) D EPOSIT OF EX CESS FUNDS.— I f, upon payment of all expenses of the establishment of the commemorative work author- ized by subsection (b) (includin g the maintenance and preservation amount provided for in section 890 6 (b) of title 40, United States Code), or upon expiration of the authority for the commemorative work under chapter 89 of title 40, United States Code, there remains a balance of funds received for the establishment of that commemo- rative work, the Marion Park Project, a committee of the Palmetto Conservation Foundation, shall transmit the amount of the balance to the Secretary of the Treasury for deposit in the account provided for in section 8906(b)( 1 ) of such title. (f) DEFINITIONS.—For the purposes of this section, the terms ‘‘commemorative work’’ and ‘‘the District of Columbia and its envi- rons’’ have the meanings given to such terms in section 890 2 (a) of title 40, United States Code. SEC.3 3 2 . DWIGHT D. EISE N H O WE RM EMORI AL COMMISSION. Section 8162 of the Department of Defense Appropriations Act, 2000 (Public L aw 106 –7 9

11 3 Stat. 1274) is amended— (1) by striking subsection (j) and inserting the following

‘‘(j) PO W ERS OF THE COMMISSION.— ‘‘(1) IN G ENERAL.— ‘‘(A) POWERS.—The Commission may— ‘‘(i) make such expenditures for services and mate- rials for the purpose of carrying out this section as the Commission considers advisable from funds appro- priated or received as gifts for that purpose; ‘‘(ii) solicit and accept contributions to be used in carrying out this section or to be used in connection with the construction or other expenses of the memo- rial; ‘‘(iii) hold hearings and enter into contracts; ‘‘(iv) enter into contracts for specialized or profes- sional services as necessary to carry out this section; and ‘‘(v) take such actions as are necessary to carry out this section. ‘‘( B ) SPECIALI Z ED OR PROFESSIONAL SERVICES.—Services under subparagraph (A)(iv) may be— ‘‘(i) obtained without regard to the provisions of title 5 , United States Code, including section 3109 of that title; and ‘‘(ii) may be paid without regard to the provisions of title 5, United States Code, including chapter 51 and subchapter III of chapter 53 of that title. 16USC43 1 note. 4 0 USC 89 03 note.
