(ii) T IM ING.— N ot later than 1 20 days after the date of enactment of this A ct, the Secretary shall make grants to States to pro v ide assistance under this sub - section. ( D ) R E QU IREMEN TS .—The Secretary shall make grants under this subsection only to States that demonstrate to the satisfaction of the Secretary that the State w ill— (i) use grant funds to assist eligible aquaculture producers
(ii) provide assistance to eligible aquaculture pro- ducers not later than 6 0 days after the date on which the State receives grant funds; and (iii) not later than 3 0 days after the date on which the State provides assistance to eligible aquaculture producers, submit to the Secretary a report that describes— (I) the manner in which the State provided assistance; (II) the amounts of assistance provided per species of aquaculture; and (III) the process by which the State deter- mined the levels of assistance to eligible aqua- culture producers. (3) RE D U C TI O NIN P A Y MENTS.—An eligible aquaculture pro- ducer that receives assistance under this subsection shall not be eligible to receive any other assistance under the supple- mental agricultural disaster assistance program established under section 5 31 of the F ederal C rop Insurance Act (7 U .S.C. 1531) and section 9 01 of the Trade Act of 197 4 (19 U.S.C. 2497) for any losses in 200 8 relating to the same species of aquaculture. (4) REPORT TO CONGRESS.—Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the appropriate committees of Congress a report that— (A) describes in detail the manner in which this sub- section has been carried out; and ( B ) includes the information reported to the Secretary under paragraph (2)(D)(iii). SEC. 103. For fiscal years 2009 and 2010, in the case of each program established or amended by the Food, Conservation, and E nergy Act of 2008 ( P ublic L aw 110 – 246), other than by title I of such Act, that is authori z ed or required to be carried out using funds of the Commodity Credit Corporation— (1) such funds shall be available for the purpose of covering salaries and related administrative e x penses, including tech- nical assistance, associated with the implementation of the program, without regard to the limitation on the total amount of allotments and fund transfers contained in section 11 of the Commodity Credit Corporation Charter Act (15 U.S.C. 714i); and (2) the use of such funds for such purpose shall not be considered to be a fund transfer or allotment for purposes Reports.D e adlin es.
