(h) S UNSET . — ( 1 ) I N G ENE RAL .— Ex cept as provided in paragraph (2), the a u thorit y provided under this section terminates at the close of Septem b er 30 , 2010. (2) E XC E P T IO N.—Any program supported from amounts in the Fund established before the close of September 30, 2010, may be completed after that date but only using amounts appropriated or transferred to the Fund on or before that date. SEC.12 2 5 . PROG R AMT O PRO VID E F ORT H E REGISTRATIO N AND END -U SE MONITORING OF DEFENSE ARTIC L ES AND DEFENSE SERVICES TRANSFERRED TO AFGHANISTAN AND PA K I- STAN. (a) P ROGRA M RE Q UIRE D .— (1) IN GENERAL.— T he Secretary of D efense shall establish and carry out a program to provide for the registration and end - use monitoring of defense articles and defense services transferred to Afghanistan and Pa k istan in accordance w ith the re q uirements under subsection (b) and to prohibit the re- transfer of such defense articles and defense services without the consent of the U nited States. The program required under this subsection shall be limited to the transfer of defense arti- cles and defense services— (A) pursuant to authorities other than the Arms Export Control Act or the Foreign Assistance Act of 1 96 1

and ( B ) using funds made available to the Department of Defense, including funds available pursuant to the Paki- stan Counterinsurgency Fund. (2) PRO H I B ITION.— N o defense articles or defense services that would be sub j ect to the program required under this sub- section may be transferred to— (A) the G overnment of Afghanistan or any other group, organi z ation, citizen, or resident of Afghanistan, or (B) the Government of Pakistan or any other group, organization, citizen, or resident of Pakistan, until the Secretary of Defense certifies to the specified congres- sional committees that the program required under this sub- section has been established. (b) REGISTRATION AND END-USE M ONITORING REQUIREMENTS.— The registration and end-use monitoring requirements under this subsection shall include the following

(1) A detailed record of the origin, shipping, and distribu- tion of defense articles and defense services transferred to— (A) the Government of Afghanistan and other groups, organizations, citizens, and residents of Afghanistan; and (B) the Government of Pakistan and other groups, organizations, citizens, and residents of Pakistan. (2) The registration of the serial numbers of all small arms to be provided to— (A) the Government of Afghanistan and other groups, organizations, citizens, and residents of Afghanistan; and (B) the Government of Pakistan and other groups, organizations, citizens, and residents of Pakistan. 2 2 USC 2 785note.
