(a) DEADLIN E FORSUBM I T TAL. —N ot l ater than 90 days after the date of the enactment of this Act , the Secretary of Defense shall s ub mit to the C ommittees on Armed Ser v ices of the Senate and the H ouse of R e p resentatives the revised rules for military commissions prescribed by the Secretary for purposes of chapter 47 A of title 1 0, U nited States Code (as amended by section 1 8 0 2 ). (b) T REATMENT OF RE V I S ED RULES UNDER RE Q UIREMENT FOR NOTI C E AND W AIT RE G ARDING M ODIFICATION OF RULES.—The revised rules submitted to Con g ress under subsection (a) shall not be treated as a modification of the rules in effect for military commissions for purposes of section 949a(d) of title 10, United States Code (as so amended). SEC. 180 6 . ANNUAL RE P ORTS TO CONGRESS ON TRIALS BY MILITARY COMMISSION. (a) ANNUAL RE P ORTS REQUIRED.—Not later than J anuary 3 1 of each year, the Secretary of Defense shall submit to the Commit - tees on Armed Services of the Senate and the House of Representa- tives a report on any trials conducted by military commissions under chapter 47A of title 10, United States Code (as amended by section 1802), during the preceding year. (b) F ORM.— E ach report under this section shall be submitted in unclassified form, but may include a classified anne x . SEC. 180 7 . SENSE OF CONGRESS ON MILITARY COMMISSION SYSTEM. I t is the sense of Congress that— (1) the fairness and effectiveness of the military commis- sions system under chapter 47A of title 10, United States Code (as amended by section 1802), w ill depend to a significant degree on the ade q uacy of defense counsel and associated resources for individuals accused, particularly in the case of capital cases, under such chapter 47A

and (2) defense counsel in military commission cases, particu- larly in capital cases, under such chapter 47A of title 10, United States Code (as so amended), should be fully resourced as provided in such chapter 47A.
