Any transfer pursuant to this provision shall be treated as a repro g ramming of funds under section 505 of this Act and shall not be available for obligation except in compliance with the procedures set forth in that section. Notwithstanding any other provision of law, no funds shall be used to implement by R eduction in F orce or other involuntary separations ( except for cause ) by the National Aeronautics and Space Administration prior to September 3 0, 2 010. T he unexpired balances of the Science, Aeronautics, and E xplo- ration account, for activities for which funds are provided under this Act, may be transferred to the new accounts established in this Act that provide such activity. B alances so transferred shall be merged with the funds in the newly established accounts, but shall be available under the same terms, conditions and period of time as previously appropriated. N ATION A L S C I E NCE FO U N D ATION R E S EARC H AND RELATED ACTI V ITIES ( INCLUDIN G TRANS F ER OF FUNDS ) For necessary expenses in carrying out the National Science Foundation Act of 1 9 50, as amended ( 4 2 U .S. C . 1 86 1 – 18 7 5), and the Act to establish a National M edal of Science (42 U.S.C. 1880– 1881)

services as authori z ed by 5 U.S.C. 3109; maintenance and operation of aircraft and purchase of flight services for research support; ac q uisition of aircraft; and authorized travel; $ 5,617,920,000, to remain available until September 30, 2011, of which not to exceed $570,000,000 shall remain available until expended for polar research and operations support, and for reimbursement to other Federal agencies for operational and science support and logistical and other related activities for the United States Antarctic program

d, That from funds specified in the fiscal year 2010 budget request for icebrea k ing services, $54,000,000 shall be transferred to the U.S. Coast G uard ‘ ‘ O perating Expenses ’ ’ within 60 days of enactment of this Act: Provided fu r th er , That receipts for scientific support services and materials furnished by the National Research Centers and other National Science Foundation supported research facilities may be credited to this appropriation: Provided further, That not less than $147,120,000 shall be available for activities authorized by section 7002(c)(2)(A)(iv) of P ublic L aw 110–69. M A J OR RESEARCH E Q UI P MENT AND FACILITIES CONSTRUCTION For necessary expenses for the acquisition, construction, commissioning, and upgrading of ma j or research equipment, facili- ties, and other such capital assets pursuant to the National Science Foundation Act of 1950, as amended (42 U.S.C. 1861–1875), including authorized travel, $117,290,000, to remain available until expended: Provided, That none of the funds may be used to reimburse the J udgment Fund.
