SEC.1865 . IN C R E A SE DP ENA LT IES FO R FALSE STATE M ENTS. Section 257 of the Trade Act of 1974, as redesignated by section 1864(a), is amended to read as follows: ‘ ‘SEC. 2 5 7 . PENALTIES. ‘‘Any person who— ‘‘(1) makes a false statement of a material fact knowing it to be false, or knowingly fails to disclose a material fact, or willfully o v ervalues any security, for the purpose of influ- encing in any way a determination under this chapter, or for the purpose of obtaining money, property, or anything of value under this chapter, or ‘‘(2) makes a false statement of a material fact knowing it to be false, or knowingly fails to disclose a material fact, when providing information to the Secretary during an inves- tigation of a petition under this chapter, shall be imprisoned for not more than 2 years, or fined under title 18, United States Code, or both.’’. SEC. 1866. ANN U AL REPORT ON TRADE AD J USTMENT ASSISTANCE FOR FIRMS. (a) I N G ENERAL.— N ot later than December 15, 2009, and each year thereafter, the Secretary of Commerce shall prepare a report containing data regarding the trade ad j ustment assistance for firms program provided for in chapter 3 of title II of the Trade Act of 1974 (19 U.S.C. 2341 et se q .) for the preceding fiscal year. The data shall include the following: (1) The number of firms that inquired about the program. (2) The number of petitions filed under section 251. (3) The number of petitions certified and denied.
