‘ ( ii ) the amount (if any) of the child enrollment contingency fund payment under subsection (n); and ‘‘(iii) the amount of the S tate ’ s allotment for the fiscal year . ‘‘( B ) PRO R ATI O N R ULE . —I f the amounts a v ailable for redistribution under paragraph ( 1 ) for a fiscal year are less than the total amounts of the estimated shortfalls determined for the year under subparagraph ( A ) , the amount to be redistributed under such paragraph for each shortfall State shall be reduced proportionally. ‘‘( C ) R ETRO SP E C TI V EA DJ UST M ENT.— T he Secretary may ad j ust the estimates and determinations made under para - graph (1) and this paragraph with respect to a fiscal year as necessary on the basis of the amounts reported by States not later than N ovember 30 of the succeeding fiscal year, as approved by the Secretary.’’. ( 2 ) EF FECTIVE DATE.—The amendments made by paragraph (1) shall apply to redistribution of allotments made for fiscal year 200 7 and subse q uent fiscal years. (b) REDISTRI B UTION OF U NUSED ALLOTMENTS FOR F ISCAL Y EAR 200 6 .—Section 210 4 ( k ) (42 U.S.C. 13 9 7dd(k)) is amended— (1) in the subsection heading, by striking ‘‘T H E FIRST 2 Q UARTERS OF’’; (2) in paragraph (1), by striking ‘‘the first 2 quarters of’’; and (3) in paragraph (6)— (A) by striking ‘‘the first 2 quarters of’’; and (B) by striking ‘‘ M arch 31’’ and inserting ‘‘September 30’’. SEC.107 . OPTI O NF O RQUAL IF Y IN G STATES TO RECEI V ET H E ENHANCE D PORTION OF THE CHIP M ATCHING RATE FOR MEDICAID COVERAGE OF CERTAIN CHILDREN. (a) IN G ENERAL.—Section 210 5 (g) (42 U.S.C. 1397ee(g)) is amended— (1) in paragraph (1)(A), as amended by section 201(b)(1) of Public L aw 110 – 173— (A) by inserting ‘‘subject to paragraph (4),’’ after ‘‘Not- withstanding any other provision of law,’’; and (B) by striking ‘‘200 8 , or 2009’’ and inserting ‘‘or 2008’’; and (2) by adding at the end the following new paragraph
‘‘(4) O PTION FOR ALLOTMENTS FOR FISCAL Y EARS 20 0 9 THROU G H20 13 .— ‘‘(A) PAYMENT OF ENHANCED PORTION OF MATCHING RATE FOR CERTAIN E X PENDITURES.—In the case of expendi- tures described in subparagraph (B), a qualifying State (as defined in paragraph (2)) may elect to be paid from the State’s allotment made under section 2104 for any of fiscal years 2009 through 2013 (insofar as the allotment is available to the State under subsections (e) and (m) of such section) an amount each quarter equal to the addi- tional amount that would have been paid to the State under title X IX with respect to such expenditures if the enhanced FMAP (as determined under subsection (b)) had 42USC1397d d note.D e a d li ne.
