and (ii) re q uest from each prime contractor or grantee that has performed wor k in Afghanistan since O ctober 7,20 0 1 , under a contract, grant, or cooperative agree - ment with their respective agencies that is valued in e x cess of $ 2 5 ,000, information that may be used to verify the employment of such citizens or nationals by such contractor or grantee . ( B ) INFORMATI ONR EQU IRE D . —T o the extent data is available, the information referred to in subparagraph (A) shall include the name and dates of employment of, biometric data for, and other data that can be used to verify the employment of each citizen or national of Afghanistan who has performed work in Afghanistan since October 7, 2001, under a contract, grant, or cooperative agreement with an executive agency. (2) R E P ORTONE S TA BL IS H MENT OF DATABASE.— N ot later than 120 days after the date of the enactment of this Act, the Secretary of D efense, in consultation with the Administrator of the United States Agency for International Development, the Secretary of H omeland Security, the Secretary of State, and the Secretary of the Treasury, shall submit to the appro- priate committees of C ongress a report examining the options for establishing a unified and classified database of information related to contracts, grants, or cooperative agreements entered into by executive agencies for the performance of work in Afghanistan since October 7, 2001, including the information described and collected under paragraph (1), to be used by relevant F ederal departments and agencies to ad j udicate ref- ugee, asylum, special immigrant visa, and other immigration claims and applications. ( 3 ) REPORT ON NON C OMPLIANCE.—Not later than 1 8 0 days after the date of the enactment of this Act, the P resident shall submit to the appropriate committees of Congress a report that describes— (A) the inability or unwillingness of any contractor or grantee to provide the information requested under para- graph (1)(A)(ii); and (B) the reasons that such contractor or grantee pro- vided for failing to provide such information. ( 4 ) EX ECUTI V EA G ENC Y DEFINED.—In this subsection, the term ‘ ‘executive agency ’ ’ has the meaning given that term in section 4 of the Office of Federal Procurement Policy Act (41 U.S.C. 403). (d) RULE OF CONSTRUCTION.—Nothing in this section may be construed to affect the authority of the Secretary of Homeland Security under section 105 9 of the National Defense Authorization Act for Fiscal Y ear 200 6 (Public L aw 109 – 163; 8 U.S.C. 1101 note). This division may be cited as the ‘‘Departments of Labor, Health and Human Services, and Education, and Related Agencies Appro- priations Act, 2009’’.
