Approved, March 3, 1875. [No. 8.] J olnt resolution for the relief of Lowell A. Chamberlain Lfgrqh 3, 1875, Whereas, it appears that Lowell A. Chamberlain was induced to tonderthe resignation of his commission of nrst lieutenant in the First regiment of Artillery, United States Army, under the apprehension of being dismissed therefrom by sentence of a general court-martial, which resignation was accepted by the President of the United States, to date November seventeenth, eighteen hundred and seventy-three; and Whereas the vacancy created by the acceptance of the said resignation has been iilled by promotion in regular course: now therefore, Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That the President be, and he Lowell A. chamis hereby, authorized and empowered to restore the said Lowell A. b°'£’·‘” f§“°"?‘l °° Chamberlain to his position in the Third Regiment of Artillery, United {;”;,_,;§,_ P°°m°° States Army, with the same rank and date of commission, and without _ forfeiture of pay, as if he had not tendered his resignation; Provided, P*°*’*¤°- That the President shall be convinced, upon an examination of the evidence in the case, that the dismissal of the said Chamberlain by sentence of the general court martial, before which he was tried, would have been unjust and not warranted by the facts; And provided further, Proviso. That no vacancy which may hereafter occur in the grade of first lieutenant in the First Regiment of Artillery, United States Army, shall be filled until the number of officers in that grade in the said regiment shall be reduced to the number now allowed by law.
