McClintock for the refunding of assed taxes to be certain taxes alleged to have been improperly and illegally assessed ¥°°P°¤°d- and collected, namely, for the amount of three thousand six hundred dollars, as claimed by him in the papers now on file in the Treasury Department; and if, upon reopening and rcconsideriug said claim, said Commissioner shall find said taxes, or any parts of the same, to have been illegally or improperly assessed and collected hom said claimant, it is hereby made his duty to audit and ascertain the amount of taxes so illegally and improperly collected from said claimant, deducting, however, any legal unpaid taxes which claimant should have paid, and did not, if any there shall bc, under section one hundred and three of tha vm. 13, p. 275. act of J unc thirtieth, eighteen hundred and sixty-four, entitled “Au act to provide internal revenue to support; the Government, to pay interest on the public debt, and for other purposes."And the Secretary of the Apvwpriation Treasury is hereby authorized and required to pay, out of any money 5‘;f8_""'°““* '°“°d in the Treasury not otherwise appropriated, tho amount of taxes so found by said Commissioner of Internal Revenue us aforesaid to have been illegally and improperly assessed and collected, to the said John M.
