That on and after June thirtieth., eighteen hundred and Vol.28,p.841.ninety-eight, every place appropriated to the crew of a seagoing vessel _ of the United States, except a fishing vessel, yacht, a pilot boat, and all vessels under two hundred tons register, shall have a space of not less than seventy-two cubic feet and not less than twelve square feet measured on the deck or floor of that place for each seaman or apprening 0,, mw M, tice lodged therein: Provided, That any such seagoing sailing vessel, mimnt vemis. built or rebuilt after June thirtieth, eighteen hundred and ninety-eight, shall have a space of not less than one hundred cubic feet and not less than sixteen square feet measured on the deck or floor of that space for each seaman or apprentice lodged therein. Such place shall be securely constructed, properly lighted, drained, heated and ventilated, properly protected from weather and sea, and, as far as practicable, properly shut oil' and protected from the etiluvium of cargo or bil ge water. Fj_¤tl:i¤sdiI;i·;¤z¤{_j;:,•; Fishing vessels, yachts, and pilot boats are hereby exempted from Z;€mpi°°;mm° mw the provisions of section one of chapter one hundred and seventy-three °P3.*;{,8 P M, of the laws of eighteen hundred and ninety-five, entitled *•An Act to ’' amend section one of chapter three hundred and ninety-eight of the laws of eighteen hundred and eighty-two, entitled *An Act to provide for deductions from the gross tonnage of vessels of the United States,"’ so far as said section prescribes the amount of space which shall be appropriated to the crew and provides that said space shall be kept free from goods or stores not being the personal property of the crew _ in use during the voyage. ,,,.§:$°*},§§‘g,{,?§,‘}},‘f,,,€‘;,§ And on and after June thirtieth, eighteen hundred and ninety-eight, Riwr ¤¢¤¤¤=¤¤- every steamboat of the United States plyiug upon the Mississippi River or its tributaries shall furnish an appropriate place for the crew, which shall conform to the requirements of this section so far as they shall be applicable thereto by providing sleeping room in the engine room of the steamboats properly protected from the cold, winds, and - rain by means of suitable awnings or screens on either side of the guards or sides and forward, reaching from the boiler deck to the lower or main deck, under the direction and approval of the Supervising Inspector-General of Steam Vessels, and shall be properly heated. The master of every vessel bound on a foreign voyage mum from vgysgs. or engaged in the whale fishery shall exhibit the certified copy of the ,,,*§,S{j;,§‘,$°"°'°·"‘“°°· list of the crew to the first boarding officer at the iirst port in the United States at which he shall arrive on his return, and also produce the persons named therein to the boarding odlcer, whose duty it shall be to examine the men with such list and to report the same to the collector; and it shall be the duty of the collector at the port of arrival, where the same is diiiercnt from the port from which the vessel originally sailed, to transmit a copy of the list so reported to him to the collector n_1;f,{{{*",{’r0*’¤§;"';j’r'j)€ of the port from which such vessel originally sailed. For each failure mma. to produce any person on the certified copy of the li t of the crew the master and owner shall be severally liable to a penalty of four hundred dollars, to be sued for, prosecuted, and disposed of in such manner as _ penalties and forfeitures which may be incurred for otlenses against the E’°“"’"°"‘ laws relating to the collection of duties; but such penalties shall not be incurred on account of the master not producing to the first boarding officer any of the persons contained in the list who may have been dis— charged in a foreign country with the consent of the consul, vice-consul, commercial agent, or vice-commercial agent there residing, certified in writing, under his hand and official seal, to be produced to the collector with the other persons composing the crew, nor on account of any such person dying or absconding or being forcibly impressed into other service of which satisfactory proof shall also be exhibited to the collector."
