Be it enacted by the Senate uml [Iowa of Rqn*esentatices oft/m [Brite:} [ ] Ntates of America in Clmgress a.s·sembZecZ, That the Chicago, Milwaukee Y<¤11<>vv¤¤>n¤ River. and Saint Paul Railway Company, of Montana, its successors and M}°;l*,lgag0,r;l;wtl.kte assigns, be, and are hereby, authorized to construct and maintain such ${5, SQL';;;?} railroad bridge or bridges and approaches thereto, across the Yellow- bridge-_ stone River, at such convenient and practicable pointor points within I‘°°°m°”' the limits of the State of Montana as said company may deem necessary, subject to the approval of the Secretary of War and the Chief of Engineers of the Army. Sec. 2. That any bridge herein authorized shall be located and con- a Sgfjgjggg ;V,g't° · structed under and subject to such regulations for the security of the pp` navigation of said river as the Secretary of War shall prescribe, and ` said company shall submit to the Secretary of lVar, for his approval, a plan of any such bridge and a map of its location, showing for one mile above and one mile below the proposed location, the topography of the banks of the river, the shore lines at high and low water, the direction and strength of the current, soundings showing the bed of the stream, the location of any other bridge in that vicinity, and such other information as may be required for a full and satisfactory understanding of the subject; and until said plan andlocation are approved by the Secretary of War such bridge shall not be commenced or built; and should any change be made in the plan of any bridge during the chansenprogress of construction or after completion such change shall also be subject to the approval of the Secretary of Wa1·. Sec. 3. That any bridge and its accessories constructed in accord- ,,,,l,;“,,‘j,’,§“,,},,,;°f“°‘“'° ance with the provisions of this Act shall be a lawful structure, and the same is hereby declared to be a post route, and no higher charge shall be made for the transportation of the mails and the troops and munitions of war of the United States over the same than the rate per mile paid for their trans rtation over the railroads leading to such bridge; and the United Stintes shall have the right of way across the same and its approaches for postal, telegraph, and telephone purposes; and equal privileges in the use thereof shal be granted to all telegraph dThg;cu¤»p1¤, ew., and telephone companies. g "

havc and be entitled to equal rights and privileges in the passage of railroad trains over same and the approaches thereto, under and upon such terms and conditions as shall be (prescribed by the Secretary of War, upon hearing the allegations an proofs of the parties in case they shall not agree. That in case of any litigation arising by reason of the con- ri¤is¤¤¤¤- struction and maintenance of any such brid e the same may be tried in the circuit or district court of the United States for the district of Montana in whose jurisdiction said bridge is located. Sec. 6.
