CHAP. 140.-An Act Authorizing the Sunbury Bridge Company, its success- ors and assign s, to constru ct, mai ntain, and op erate a bridge acros s the S usque- hanna River at or near Bainbridge Street, in the city of Sunbury, Pennsylvania . Be it enacted by the Senate and House of Representatives of the United States o f America in Congress assembled, That in order to p romote inte rstat e comm erce, improve the Postal Service, and pro- vide for military and o ther purpo ses, t he Su nbury Bridg e Com pany, a corporation organized under the laws of the State of Pennsyl- van ia, its successo rs and assigns, be, and is hereb y, authorized to con- st ruct, ma intain, and oper ate a br idge and approac hes ther eto acro ss th e Susque hanna Ri ver, at a point suitable to the interest s of nav i- ga tion, at or near Bainbri dge Stre et, in t he city of Sunbu ry, Nort h- timberland County, Pennsylvania, to a point at or near the Borough of Shamokin Dam, in the county of Snyder, Pennsylvania, in accord- ance with the provisions of the Act entitled "An Act to regulate the construction of bridges over navigable waters," approved March 23 , 1906, and subj ect to t he condi tions an d limita tions co ntained in this Act. SEC. 2. After the completion of such bridge, as determined by the Secretary of War, either the State of Pennsylvania, any political subdi vision thereof within or ad joining which any part of such b ridge is located, or any two or more of them jointly, may at any tim e acquire and ta ke over all righ t, title, and in terest in such b ridge and its approaches, and any interest in real property necessary there- fo r, by purchase or by condemnation in accordance with the la ws of such State governing the acquisition of private property for public purposes by condemnation or expropriation . If at any time after the expiration of twenty years after the completion of such bridge the same is acqui red by cond emnat ion or expr opria tion, the a mount of damages or compensation to be allowed shall not include go od will, going value, or prospective revenues or profits, but shall be limited to the sum of (1) the actual cost of construct ing such b ridge and its approaches, less a reaso nable dedu ction for a ctual depreciation in value, (2) the actual cost of acquiring such interest in real property, (3) actual financing and promotion cost, not to exceed 10 per centum of the sum of the cost of constructing the brid ge and its ap proa che s and ac quir ing such int eres t in rea l proper ty, a nd (4 ) actu al ex pendi tures for n ecess ary im prove ments . SEC . 3 . If such bridge shall at any time be taken over or acquired by the S tate of Pennsylv ania or b y any mu nicipali ty or ot her poli ti- cal subdivision thereof, under the provisions of section 2of this Act, and if tolls are charged for the use thereof, the rates of tolls shall be so adjusted as to provide a fund sufficient to pay for the reasonable cost of maintaining, repairing, and operating the bridge and its approaches under ec onomical management, and to provide a sinking fund sufficient to amortize the amount paid therefor includ- ing reasonable interest and financing cost, as soon as possible under reasonable charges, but within a period not to exceed twenty years from the da te of acquiring the sa me .
