CHAP. 468 .-An Act Authorizing the State of Indiana to construct, main- [Public, No. 333 .] tain, and operate a toll bridge across the Ohio River at or near Rockport, Indiana . Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That in order to promote inters tate commerce , improve the postal servic e, and pr o- vide for military and other purposes, the State of Indiana, acting by and through its State hi ghway commiss ion and the su ccessors of said commission, be, and is hereby, authorized to construct, maintain, and operate a bridge and ap proaches ther eto across the Ohio River at a point suitable to the interests of navigation, at or near the city at Rockport, Indiana, across said river to a point opposite in Daviess County, Kentucky, in accordance with the provisions of the Act enti tled "An Act to regu late the con stru ctio n of bri dges ove r na vi- gable waters," approved March 23, 1906, and subject to the condi- tions and limitations contained in this Act . SEC. 2 . There is hereby conferred upon the State of Indiana, acting by and through its State highway commission, and the successors of said commission, all such rights and powers to enter upon lands and to acquire, condemn, occupy, possess, and use real estate and other property needed for the location, construction, maintenance, and operation of such bridge and its approaches as are possessed by railroad corporations for railroad purposes or by bridge corpora- tions for bridge purposes in the State in which such real estate or other property is situated, upon making just compensation therefor, to be ascertained and paid according to the laws of such State, and the proceedings therefor shall be the same as in the condemnation or expropriation of property for public purposes in such State . Tolls authorized . SEC . 3 . The State of Indiana, acting by and through its State highway commission and the successors of said commission, is hereby authorized to fix and charge tolls for transit over such bridge, and the rates of toll so fixed shall be the legal rates until changed by the Secretary of War under the authority contained in the Act of March 23, 1906 . In fixing the rates of toll to be charged for the use of funop eration,, s in kin g such bridge the same shall be so adjusted as to provide a fund suffi- cient to pay for the reasonable cost of maintaining, repairing, and operating the bridge and its approaches, under economical manage- ment, and to provide a sinking fund sufficient to amortize such bonds or other securi ties as may b e legal ly issu ed by said St ate for the c ost Ohio Rive r . Be it enacted by the Senate and House o f Representatives o f the United States of America in Congress assembled, That the consent of Congress is hereby granted to the State of North Dakota, the State of Minnesota, the county of Cass, North Dakota, the county of Clay, Minnesota, the city of county North Dakota, and the city of Moorhead, Minnesota, or to any one or more of them to construct, maintain, and operate a free highway bridge across the Red River of th e North at a point s uitable to th e inter ests of navig ation b etween Fargo, North Dakota, and Moorhead, Minnesota, in accordance with the provisions of an Act entitled "An Act to regulate the construc- tion of bridges over navigable waters," approved March 23, 1906 .
