CANADA-FUR SEALS-DEC. 26 , 1947 1821 Agreement between the United States of America and Canadaamending the provisional agreement of December 8 and 19, 1942, respecting fur seals. Effected by exchange of notes signed at Washington Decem- ber 26, 1947; entered into force December 26, 1947. The Secretary of State to the Canadian Ambassador WASHINGTON, D.C. December 26, 1947. EXCELLENCY: I have the honor to refer to conversations which have taken place between representatives of the Government of the United States of America and representatives of the Government of Canada with re- gard to the possibility of amending the Provisional Fur Seal Agree- ment between the United States and Canada effected by exchange of notes signed at Washington, December 8 and 19, 1942, with a view to assuring continuing protection of the fur seal herd. I am glad to inform you that legislation has recently been enacted by the Congress of the United States of America which provides for the extension for an indefinite period of existing laws for the en- forcement of the Provisional Fur Seal Agreement. This Govern- ment will, therefore, continue to be in position to give full force and effect to the provisions of that Agreement. Accordingly, the Government of the United States of America pro- poses that the final sentence of Article X of the Provisional Fur Seal Agreement which relates to the duration of the Agreement, shall be amended to read as follows: "The Agreement shall remain in effect until (a) either the Govern- ment of the United States of America or the Government of Canada enacts legislation contrary to its provisions; or (b) the date of entry into force of a new agreement for the preservation and pro- tection of fur seals to which the United States of America and Canada, and possibly other interested countries, shall be parties; or (c) twelve months after either Government shall have notified the other Government of an intention of terminating the Agree- ment." If the foregoing proposal is acceptable to the Government of Canada, the Government of the United States of America will regard this note and your reply thereto as constituting an agreement between the two Governments amending the Provisional Fur Seal Agreement, with effect from the date of your note in reply.
