findings of fact and may modify his previous action, and shall file in the court the record of the further proceedings. Such new or modified findings of fact shall likewise be conclusive if supported by substantial evidence. "(c) Upon the filing of such petition, the court shall have jurisdiction to affirm the action of the Commissioner or to set it asidCj in whole or in part. The judgment of the court shall be subject to review by the Supreme Court of the United States upon certiorari or certification as provided in section 1254 of title 28, United States Code. " ^ T

N A T I O N A L ADVISORY

COUNCIL

"SEC. 212. (a) The President shall, within ninety days after the enactment of this title, appoint a National Advisory Council on the Education of Disadvantaged Children for the purpose of reviewing the administration and operation of this title, including its effectiveness in improving the educational attainment of educationally deprived children, and making recommendations for the improvement of this title and its administration and operation. These recommendations shall take into consideration experience gained under this and other Federal educational programs for disadvantaged children and, to the extent appropriate, experience gained under other public and l)rivate educational programs for disadvantaged children. " (b) The Council shall be appointed by the President without regard to the civil service laws and shall consist of twelve persons. Wlien requested by the President, the Secretary of Health, Education, and Welfare shall engage such technical assistance as may be required to carry out the functions of the Council, and the Secretary shall make available to the Council such secretarial, clerical, and other assistance and such pertinent data prepared by the Department of Health, Education, and Welfare as it may require to carrv out such functions. dentTnd c°o^'^^'" "(c) The Couucil shall niake an annual report of its findings and gress. recommendations (including recommendations for changes in the provisions of this title) to the President not later than March 81 of each calendar year beginning after the enactment of this title. AMENDMENTS

SEC. 3. (a) Clause (A) of section.3(c)(4) of the Act of September 30, 10.50, Public Law 874, Eighty-first Congress, as amended (20 U.S.C. 2-38 (c)(4)(A)) is amended by strikingout ") is," and inserting ", but excluding funds available under title II) is,". (b) The sentence which immediately follows clause (B) of section 4(a) of such Act (20 U.S.C. 2.39(a)(B)) is amended by inserting "(exclusive of funds available under title II) " immediately after "Federal funds".
