(B) The President may not, under this paragraph, increase the maximum number of civilian employees in the executive branch by more than the percentage increase of the population of the United States since September 30, 1978, as estimated by the Bureau of the Census. (e) The President shall provide that no increase occurs in the procurement of personal services by contract by reason of the enactment of this section except in cases in which it is to the financial advantage of the Government to do so. (f) The President shall prescribe regulations to carry out the purposes of this section. (g) The provisions of this section shall terminate on January 31, 1981. SEC. 401. (a) Chapter 21 of title 5, United States Code, is amended by inserting after section 2101 the following new section: "§ 2101a. The Senior Executive Service "The 'Senior Executive Service' consists of Senior Executive Service positions (as defined in section 3132(a)(2) of this title).". (b) Section 2102(a)(1) of title 5, United States Code, is amended— (1) by striking out "and" at the end of subparagraph (A); (2) by adding "and" at the end of subparagraph (B); and (3) by adding at the end thereof the following new subparagraph: "(C) positions in the Senior Executive Service;". (c) Section 2103(a) of title 5, United States Code, is amended by inserting before the period at the end thereof the following: "or the Senior Executive Service". (d) Section 2108(5) of title 5, United States Code (as amended in section 307 of this Act), is further amended— (1) by striking out the period at the end thereof and inserting in lieu thereof a semicolon; and (2) by adding at the end thereof the following: "but does not include applicants for, or members of, the Senior Executive Service.". (e) The analysis for chapter 21 of title 5, United States Code, is amended by inserting after the item relating to section 2101 the following new item: "2101a. The Senior Executive Service.". SEC. 402. (a) Chapter 31 of title 5, United States Code, is amended by inserting after section 3112 (as added by section 307(b) of this Act), the following new subchapter: "SUBCHAPTER II—THE SENIOR EXECUTIVE SERVICE
