PART G—BANK FRAUD

SEC. 1108. (a) Chapter 63 of title 18 of the United States Code is amended by adding a new section as follows: "§ 1344. Bank fraud "(a) Whoever knowingly executes, or attempts to execute, a scheme or artifice— "(1) to defraud a federally chartered or insured financial institution; or "(2) to obtain any of the moneys, funds, credits, assets, securities or other property owned by or under the custody or control of a federally chartered or insured financial institution by means of false or fraudulent pretenses, representations, or promises, shall be fined not more than $10,000, or imprisoned not more than five years, or both. "(b) As used in this section, the term 'federally chartered or insured financial institution' means— "(1) a bank with deposits insured by the Federal Deposit Insurance Corporation; "(2) an institution with accounts insured by the Federal Savings and Loan Insurance Corporation; "(3) a credit union with accounts insured by the National Credit Union Administration Board; "(4) a Federal home loan bank or a member, as defined in section 2 of the Federal Home Loan Bank Act (12 U.S.C. 1422), of the Federal home loan bank system; or "(5) a bank, banking association, land bank, intermediate credit bank, bank for cooperatives, production credit association, land bank association, mortgage association, trust company, savings bank, or other banking or financial institution organized or operating under the laws of the United States.". 0)) The analysis for chapter 63 of title 18 of the United States Code is amended by adding at the end thereof the following: "1344. SEC. 1109. (a) Section 1791 of title 18, United States Code is amended to read as follows:

  • '§ 1791. Providing or possessing contraband in prison

"(a) OFFENSE.—A person commits an offense if, in violation of a statute, or a regulation, rule, or order issued pursuant thereto— "(1) he provides, or attempts to provide, to an inmate of a Federal penal or correctional facility— "(A) a firearm or destructive device; "(B) any other weapon or object that may be used as a weapon or as a means of facilitating escape; "(C) a narcotic drug as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802); "(D) a controlled substance, other than a narcotic drug, as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802), or an alcoholic beverage; "(E) United States currency; or
