MUNICIPAL ORDINANCE NO. 5 – 2022

Ordinance Prohibiting the Compounding, Dispensing, Selling or Reselling of Pharmaceutical Products Through Retail Drug Outlets Not Licensed by the Food and Drug Administration (FDA) and Providing Penalties For Violation Thereof

WHEREAS, from January 13 to February 11, 2022, the Food and Drug Administration (FDA) received 185 reports on sari-sari stores that were illegally selling medicines of which 78 were confirmed guilty;

WHEREAS, on Sec. 30 of R.A. No. 10918 or otherwise known as “Philippine Pharmacy Act” states that FDA licensed retail drug outlets or pharmacies are allowed to sell drugs and medicine to the consuming public;

WHEREAS, DILG issued Memorandum Circular No. 2022 - 025 to all Provincial and Local Government Units regarding the dispensing, selling and reselling of pharmaceutical products in sari-sari store;

WHEREAS, Sec. 447 of RA 7160, the Sangguniang Bayan as a legislative body of the municipality shall enact ordinances and measures for the general welfare of the municipality and its inhabitants;

WHEREAS, on Sec. 16 of the same Code states that the Municipal Government has the implied power to do all things necessary, appropriate or incidental to govern, efficiently and effectively, promote general welfare, promote health and safety, maintain peace and order and preserve the comfort and convenience of their inhabitants;

WHEREAS, any sari-sari store/retail outlet may sell, dispense and resell over the counter medicines provided that they have complied and secure a license to operate from the Food and Drug Administration (FDA);
