b. If necessary, referring violators to the municipal government and/or PNP for apprehension; and

c. Integration of these guidelines and regulations in their barangay permit system requirements.

Sec. 8. Role of Local Government Unit.

a. The LGU shall ensure the integration of these guidelines and regulations in their existing business permit and licensing systems and requirements.

b. LGU shall also establish mechanism designed to assist the sari-sari store owners and other retail stores in securing proper authorization from the FDA to dispense, sell and resell pharmaceutical products.

Sec. 9. Agencies/Offices To Enforce and Implement this Ordinance. The following agencies/offices are tasked and enjoined to provide assistance and utilize all their available resources as are necessary for the implementation and enforcement of this Ordinance. The lead agency is the Office of the Municipal Health Officer, BPLO – Business Permit and Licensing Officer and the coordinating agencies/offices are the PNP Urbiztondo under the leadership of the Chief of Police and Barangay Officials/Tanods who shall apprehend the owners of sari-sari store who are dispensing, selling and reselling pharmaceutical products within their territorial jurisdiction.

Sec. 10. Penalty. Any individual or owner of sari-sari store/owner of retail outlets found to be in violation of this Ordinance shall be charged with the following penalties:

a. First Offense - Php500.00

b. Second Offense - Php1,500.00

c. Third Offense and subsequent offense - Php2,500.00 plus imprisonment of not less than or more than six months upon the discretion of the court and cancellation or revocation of his/her business permit for a period of one year

Sec. 11. Repealing Clause. All existing ordinances, rules and regulations, as well as orders inconsistent herewith are hereby repealed or modified accordingly.

Sec. 12. Separability. Should any of these clauses or parts of this Ordinance be declared unconstitutional by any court of competent jurisdiction, all other remaining portions not so declared shall remain valid and effective.

Sec. 13. Effectivity. This ordinance shall take effect upon favorable review and approval by the Sangguniang Panlalawigan and after fifteen (15) days upon its publication in a newspaper of local circulation pursuant to and in conformity with pertinent provisions of the Local Government Code of 1991 (R.A. 7160).

I hereby certify to the passage of the foregoing Ordinance which was duly approved by the Sangguniang Bayan of Urbiztondo on the 20th day of June, 2022.
