The Department for Regional Development[1] makes the following Order in exercise of the powers conferred by Articles 10(4), 13(1) and (4) of the Road Traffic Regulation (Northern Ireland) Order 1997[2] and now vested in it[3].

It appears to the Department to be necessary to provide suitable parking places for vehicles on the lengths of road specific in Article 2.

The Department has consulted such persons as it considered appropriate in compliance with paragraphs 1 and 2 of Schedule 4 to that Order.

The Department has published a notice in compliance with paragraphs 1 and 3 of that Schedule.

The Department, in compliance with paragraph 3(4) of that Schedule has taken such other steps as appear to it reasonably practicable of the purpose of bringing specifically to the knowledge to the occupiers of land adjacent to the parking places the particulars specified in paragraph 3(2) of that Schedule.

No written objection or other representation has been received.

Citation and commencement

1. This Order may be city as The Loading Bays on Road (Amendment No. 2) Order (Northern Ireland) 2013 and shall come into operation on 31st July 2013.

Amendments

2.—(1) The Loading Bays on Roads Order (Northern Ireland) 2007[4] shall be amended in accordance with paragraphs 2 and 3.

(2) The following item shall be added to Schedule 1—

“131. Linenhall Street, Belfast (west side) – from a point 30 metres south of its junction with Donegall Square South for a distance of 13 metres in a southerly direction. 7.00 a.m. to 7.00 p.m. Monday to Saturday inclusive”

(3) The following item shall be added to Schedule 2—

“56. Great James Street, Londonderry (south side) – from a point 36 metres east of its junction with Lower Road for a distance of 13 metres in a south-easterly direction. 8.00 a.m. to 6.30 p.m. Monday to Saturday inclusive”

3. The On-Street Parking Order (Northern Ireland) 2000[5] shall be amended by the substitution for item 66 of Chapter 1, Part 1 of Schedule 1 of the same description together with a new map.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends The Loading Bays on Roads Order (Northern Ireland) 2007 (“the Order”) by the addition to Schedule 1 of the item specified in Article 2(2) and the addition to Schedule 2 of the item specified in Article 2(3).

The length of road specified in Article 2(2) is presently contained within a parking place designated under Article 5 of, and Schedule 1 to, the On Street Parking Order (Northern Ireland) 2000 (“the 2000 Order”). This Order also amends the 2000 Order by redefining the designated parking place in question to exclude this length of the road (Article 3).

A penalty charge (£90) is payable with respect to a vehicle involved in a contravention of the Order in accordance with the Traffic Management (Northern Ireland) Order 2005 and The Penalty Charges (Prescribed Amounts) Regulations (Northern Ireland) 2006.

Traffic signs indicating the effect of the Order will in due course be placed on the roads.
