Act Amending
the Penal Code,
2475 Buddhist Era

Phra Bat Somdet Phra Paramin Maha Prajadhipok Phra Pok Klao Chaoyuhua gives a great royal command by which He orders with His pleasure that it be announced as follows:

Whereas the House of Representatives has advised Him that it is appropriate to modify certain sections of the Penal Code of 127 RE anew;

Therefore, by and with the advice and consent of the House of Representatives, He orders with His gracious pleasure that enacted shall be an Act containing the following sections:

Section⁠1.⁠This Act shall be called the "Act Amending the Penal Code, 2475 Buddhist Era".

Section⁠2.⁠This Act shall come into force from the day of its publication in the Royal Gazette onwards.

Section⁠3.⁠The provisions of section 185 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠185.⁠Should any person set fire to movable property which belongs to another person, Lord says that he be held guilty and be punished with imprisonment from six months up to seven years and an additional fine from fifty thousand baht up to a thousand baht."

Section⁠4.⁠The provisions of section 186 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠186.⁠Should any person set fire to any of the following property, namely—

(1)⁠a dwelling where a human resides;

(2)⁠a public place or place of religious respect;

(3)⁠a forest;

(4)⁠a place or floating house of any kind where goods and merchandise are kept or made;

(5)⁠any other immovable property which does not belong to him;

Lord says that he be held guilty and be punished with imprisonment from ten years up to the whole life and a fine from a thousand baht up to ten thousand baht.

If the setting of this fire causes any person to die, Lord ordains that he be put to death or imprisoned for the rest of his life."

Section⁠5.⁠The provisions of section 187 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠187.⁠Whoever causes fire to any property in such a manner likely to harm people or property over which another person has ownership or interest shall, Lord says, be held guilty and be punished with imprisonment from six months up to seven years and an additional fine from fifty baht up to a thousand baht.

If, as a result of such act, danger occurs to people or to the immovable property as stated in section 186, Lord says that he be held guilty and be punished as prescribed in section 186.

Whoever prepares to set fire to such property as prescribed in section 185 or section 186 shall, Lord says, be held guilty and be punished with imprisonment from six months up to seven years and an additional fine of not over a thousand baht."

Section⁠6.⁠The provisions of section 203 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠203.⁠Should anyone commit any of the offences hereinafter stated, namely—

(1)⁠forgery of currency or alteration of currency;

(2)⁠taking into the Kingdom of currency which he knows to have been forged or altered;

(3)⁠utterance of currency which he knows to have been forged or altered, or possession of such article for utterance;

Lord says that he be punished with imprisonment from ten years up to the whole life and an additional fine from a thousand baht up to ten thousand baht or decupling the value of the forged or altered money, whichever is greater."

Section⁠7.⁠The provisions of section 204 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠204.⁠Whoever obtains forged or altered currency without the knowledge that it is so shall, Lord says, be held guilty and be punished with any of the following three major and minor punishments, if he still utters it after having learnt the truth that it has been forged or altered: one is imprisonment of not more than ten years, one is a fine of not more than ten thousand baht or decupling the value of the forged or altered money, whichever is greater, the other is the imposition of both such imprisonment and fine."

Section⁠8.⁠The provisions of section 205 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠205.⁠Whoever makes a tool or object of any kind which is intended for forgery of currency or alteration of currency, or appears to have such tool or object in his possession, shall, Lord says, be held guilty and be punished with imprisonment from five years to fifteen years and an additional fine from a thousand baht to ten thousand baht."

Section⁠9.⁠The provisions of section 210 of the Penal Code shall be repealed and replaced by the following stipulations:

"Section⁠210.⁠Whoever makes a piece of paper or metal of any kind to be in a form, colour, and shape resembling a note or currency, or utters such article, shall, Lord says, be held guilty and be punished with any of the following three major and minor punishments: one is imprisonment of not more than one year, one is a fine of not more than a thousand baht, the other is the imposition of both such imprisonment and fine."

Announced on the 29th day of August 2475 Buddhist Era, being the 8th year of the present reign.
