Re: Amendments to the Announcement of the Council for Democratic Reform No 13 dated the 20th day of September 2549 Buddhist Era

Following the issuance of the Announcement of the Council for Democratic Reform No 13 dated the 20th day of September 2549 Buddhist Era which orders the Organic Act on Election Commission, 2541 BE, to continue to be in operation and establishes an Election Commission to carry out proceedings concerning local councils and local administrators in a fair, just, and continuous manner, the performance of work under the powers and duties of the Election Commission according to the Organic Act on Election Commission, 2541 BE, needs to be clarified, for which reason the Council for Democratic Reform announces as follows:

Article1.The dispositions of article 1 of the Announcement of the Council for Democratic Reform No 13 dated the 20th day of September 2549 Buddhist Era shall be repealed and replaced by the following dispositions:

“Article1.The repeal of the Constitution of the Kingdom of Thailand shall not affect the Organic Act on Election Commission, 2541 BE. The Organic Act on Election Commission, 2541 BE, shall remain in operation until amended or repealed by a law.”

Article2.Articles 2 and 3 of the Announcement of the Council for Democratic Reform No 13 dated the 20th day of September 2549 Buddhist Era shall be repealed.

Article3.The Election Commission established by the Announcement of the Council for Democratic Reform No 13 dated the 20th day of September 2549 Buddhist Era shall be deemed to have been duly recruited and established in accordance with the Organic Act on Election Commission, 2541 BE, its term of office shall begin from the date of its establishment by the said Announcement, and it shall have the powers and duties as provided in the Organic Act on Election Commission, 2541 BE, and other laws which provide for powers and duties of the Election Commission.
