มาตรา ๒๑

ศาลอุทธรณ์มีเขตตลอดท้องที่ที่มิได้อยู่ในเขตศาลอุทธรณ์ภาค

ในกรณีที่มีการยื่นอุทธรณ์คดีต่อศาลอุทธรณ์ และคดีนั้นอยู่นอกเขตของศาลอุทธรณ์ ศาลอุทธรณ์อาจใช้ดุลพินิจยอมรับไว้พิจารณาพิพากษา หรือมีคำสั่งโอนคดีนั้นไปยังศาลอุทธรณ์ภาคที่มีเขตอำนาจ

Section 21
  1. The Court of Appeal has territorial jurisdiction over all the districts which are not under the territorial jurisdiction of the Regional Courts of Appeal.
  2. In the event that an appeal against a case is filed with the Court of Appeal and such case is outside the territorial jurisdiction of the Court of Appeal, the Court of Appeal may exercise its discretion as to whether it should accept to try and adjudicate the case or should issue an order transferring the case to the competent Regional Court of Appeal.

มาตรา ๒๒

ศาลอุทธรณ์และศาลอุทธรณ์ภาคมีอำนาจพิจารณาพิพากษาบรรดาคดีที่อุทธรณ์คำพิพากษาหรือคำสั่งของศาลชั้นต้นตามบทบัญญัติแห่งกฎหมายว่าด้วยการอุทธรณ์และว่าด้วยเขตอำนาจศาล และมีอำนาจดังต่อไปนี้

(๑) พิพากษายืนตาม แก้ไข กลับ หรือยกคำพิพากษาของศาลชั้นต้นที่พิพากษาลงโทษประหารชีวิตหรือจำคุกตลอดชีวิต ในเมื่อคดีนั้นได้ส่งขึ้นมายังศาลอุทธรณ์และศาลอุทธรณ์ภาคตามที่บัญญัติไว้ในกฎหมายวิธีพิจารณาความอาญา
(๒) วินิจฉัยชี้ขาดคำร้องคำขอที่ยื่นต่อศาลอุทธรณ์หรือศาลอุทธรณ์ภาคตามกฎหมาย
(๓) วินิจฉัยชี้ขาดคดีที่ศาลอุทธรณ์และศาลอุทธรณ์ภาคมีอำนาจวินิจฉัยได้ตามกฎหมายอื่น
Section 22

The Court of Appeal and the Regional Courts of Appeal have the power to try and adjudicate all cases in which judgments or orders of the courts of first instance are appealed in accordance with the provisions of the laws on appeal and on court jurisdiction, and have the following power:

(1) to issue judgments affirming, modifying, reversing, or dismissing judgments of the courts of first instance which sentenced persons to the punishment of death or imprisonment for life, when the cases have been sent up to the Court of Appeal and the Regional Courts of Appeal as prescribed in the criminal procedure laws;
(2) to issue decisive rulings on motions and applications filed with the Court of Appeal or Regional Court of Appeal in accordance with law;
(3) to issue decisive rulings on cases which the Court of Appeal and the Regional Courts of Appeal have the power to decide in accordance with other laws.
