มาตรา ๒๘ การแต่งตั้งพนักงานเจ้าหน้าที่ตามพระราชบัญญัตินี้ ให้รัฐมนตรีแต่งตั้งจากผู้มีความรู้และความชำนาญเกี่ยวกับระบบคอมพิวเตอร์และมีคุณสมบัติตามที่รัฐมนตรีกำหนด ผู้ที่ได้รับการแต่งตั้งเป็นพนักงานเจ้าหน้าที่ตามพระราชบัญญัตินี้อาจได้รับค่าตอบแทนพิเศษตามที่รัฐมนตรีกำหนดโดยได้รับความเห็นชอบจากกระทรวงการคลัง[28.i] ในการกำหนดให้ได้รับค่าตอบแทนพิเศษ ต้องคำนึงถึงภาระหน้าที่ ความรู้ความเชี่ยวชาญ ความขาดแคลนในการหาผู้มาปฏิบัติหน้าที่หรือมีการสูญเสียผู้ปฏิบัติงานออกจากระบบราชการเป็นจำนวนมาก คุณภาพของงาน และการดำรงตนอยู่ในความยุติธรรม โดยเปรียบเทียบค่าตอบแทนของผู้ปฏิบัติงานอื่นในกระบวนการยุติธรรมด้วย[28.ii]

Section 28 As regards competent authorities under this Act, the Minister shall appoint them from amongst[28.1] the persons having knowledge and proficiency concerning computer systems and possessing qualifications as prescribed by the Minister. The persons appointed as competent authorities under this Act may receive special compensation as determined by the Minister with the approval of the Ministry of Finance.[28.a] In determining special compensation, regard must be had to the missions and duties, the knowledge and proficiency, the lack of functionaries or the loss of large numbers of functionaries from the government system, the qualities of work, and the maintenance of oneself in righteousness, with comparison to compensation for other functionaries in the process of justice as well.[28.b][28.2]
