Designating the Opening Date of the Bueng Kan Provincial Court’s
Division for Juvenile and Family Cases
2554 BE

Being the 66th year of the present reign

His Majesty King Maha Bhumibol Adulyadej is pleased to give a Great Royal Command that it be announced as follows:

Whereas it is appropriate to designate the opening date of the Bueang Kan Provincial Court’s Division for Juvenile and Family Cases for further trial and adjudication of cases;

Therefore, by the powers of under the dispositions of section 187 of the Constitution of the Kingdom of Thailand and section 8, paragraph 2, of the Establishment of Juvenile and Family Courts and Juvenile and Family Case Procedure Act, 2534 BE—a law containing certain provisions related to the restriction of personal rights and freedoms, which section 29, in conjunction with sections 11, 34, 35, 36, 37, 48, and 50, of the Constitution of the Kingdom of Thailand permits to be done through the powers under legal provisions—He is graciously pleased to enact the following Royal Decree:

Section1.This Royal Decree is called the Royal Decree Designating the Opening Date of the Bueng Kan Provincial Court’s Division for Juvenile and Family Cases, 2554 BE.

Section2.This Royal Decree shall enter into operation from the 20th day of May 2554 BE onwards.

​Section3.The Bueng Kan Provincial Court’s Division for Juvenile and Family Cases shall open from the 20th day of May 2554 BE onwards and shall have jurisdiction throughout Bueang Kan Province.

Section4.Regarding the cases which the Nong Khai Provincial Court’s Division for Juvenile and Family Cases has, since before the opening date of the Bueng Kan Provincial Court’s Division for Juvenile and Family Cases, ordered to be heard at the Nong Khai Provincial Court, the Nong Khai Provincial Court shall continue to have the power to try and adjudicate upon them until they are finished, save where the head judge of the Nong Khai Provincial Court’s Division for Juvenile and Family Cases finds it appropriate to transfer any case to the Bueng Kan Provincial Court’s Division for Juvenile and Family Cases. In addition, the proceedings already conducted by the Nong Khai Provincial Court’s Division for Juvenile and Family Cases shall be deemed to be proceedings before the Bueng Kan Provincial Court’s Division for Juvenile and Family Cases.

Section5.The President of the Supreme Court of Justice shall be in charge of the implementation of this Royal Decree.

​Note: The grounds for promulgation of this Royal Decree are as follows: The Establishment of Bueng Kan Province Act, 2554 BE, requires that Bueang Kan District, Seka District, So Phisai District, Bung Khla District, Bueng Khlong Long District, Pak Khat District, Phon Charoen District, and Si Wilai District, be split from the administration of Nong Khai Province to jointly form Bueng Kan Province. As all the localities forming Bueng Kan Province used to be subject to the jurisdiction of the Nong Khai Provincial Court, the Nong Khai Provincial Division for Juvenile and Family Cases no longer has power to try and adjudicate upon juvenile and family cases in the area of Bueang Kan Province after the entry into operation of the Establishment of Bueng Kan Province Act, 2554 BE, and the offences committed by children and juveniles have to be prosecuted in the provincial court instead. This causes the prosecuted children and juveniles to not enjoy the benefit of the protection of rights under the law on establishment of juvenile and family courts and juvenile and family case procedure at the same level as in other areas. It is thus appropriate to open a Division for Juvenile and Family Cases within the Bueng Kan Provincial Court to perform the duty of trying and adjudicating upon juvenile and family cases. In addition, as the Establishment of Juvenile and Family Courts and Juvenile and Family Case Procedure Act, 2534 BE, section 8, paragraph 2, provides that, in other Provinces than the Provinces where juvenile and family courts have already been established in accordance with paragraph 1, a division for juvenile and family cases shall be established within every provincial court, and the time to open a provincial Court’s division for juvenile and family cases shall be announced by a royal decree. It is therefore necessary to enact this Royal Decree.
