Royal Decree
on Positional Allowances and Other Remunerative Benefits for the Presidents and Vice Presidents of the National Legislative Assembly and Constitution Drafting Assembly, Holders of Positions in the Council for National Security, Members of the National Legislative Assembly, Members of the Constitution Drafting Committee, Members of Legislative Committees, and Holders of Positions in the Constitutional Tribunal,

Being the 62nd year of the present reign

Phrabat Somdet Phra Paramin Maha Bhumibol Adulyadej gives a great royal command by which He orders with His pleasure that it be announced as follows:

Whereas it is appropriate to designate positional allowances and other remunerative benefits for the Presidents and Vice Presidents of the National Legislative Assembly and Constitution Drafting Assembly, holders of positions in the Council for National Security, Members of the National Legislative Assembly, Members of the Constitution Drafting Assembly, members of legislative committees, and holders of positions in the Constitutional Tribunal;

Therefore, He grants with His gracious pleasure, by virtue of the powers under sections 16 and 33 of the Constitution of the Kingdom of Thailand (Interim), 2549 Buddhist Era, the enactment of the following Royal Decree:

Section1.This Royal Decree is called the Royal Decree on Positional Allowances and Other Remunerative Benefits for the Presidents and Vice Presidents of the National Legislative Assembly and Constitution Drafting Assembly, Holders of Positions in the Council for National Security, Members of the National Legislative Assembly, Members of the Constitution Drafting Committee, Members of Legislative Committees, and Holders of Positions in the Constitutional Tribunal, 2550 BE.

Section2.This Royal Decree shall come into force from the 1st day of October 2549 BE[2] onwards.

Section3.The President and Vice Presidents of the National Legislative Assembly, Members of the National Legislative Assembly, President and Vice Presidents of the Constitution Drafting Assembly, and Members of the Constitution Drafting Assembly shall receive positional allowances and extra allowances on a monthly basis according to the Schedule of the Rate of Positional Allowances and Extra Allowances at the end of this Royal Decree from the day of issuance of the royal command appointing them to their positions.

The President and Vice Presidents of the Council for National Security, Members of the Council for National Security, President and Vice Presidents of the Constitutional Tribunal, and Members of the Constitutional Tribunal shall receive positional allowances and extra allowances on a monthly basis according to the Schedule of the Rate of Positional Allowances and Extra Allowances at the end of this Royal Decree from the day of taking office.

Upon receipt of the said positional allowances and extra allowances for their positions, the President and Vice Presidents of the National Legislative Assembly, President and Vice Presidents of the Constitution Drafting Assembly, and President and Vice Presidents of the Council for National Security can no longer receive the positional allowances and extra allowances for the positions of Members of the National Legislative Assembly, Members of the Constitution Drafting Assembly, Members of the Council for National Security, or Members of the Constitutional Tribunal, as the case may be.

Section4.Members of the Constitution Drafting Committee who do not hold any position under section 3 shall receive remuneration for their service on a monthly basis at the rate equivalent to the positional allowance plus the extra allowance of a Member of the Constitution Drafting Assembly.

Section5.Members of the Constitution Drafting Committee, members of the committees of the National Legislative Assembly, and members of the committees of the Constitution Drafting Assembly shall receive meeting allowance at the rate of one thousand baht per attendance only for the meetings they attend.

The members under paragraph 1 of a committee shall have the right to receive meeting allowance for one attendance per day only, save where he attends a meeting of another committee or subcommittee on that day also, in which case he shall receive meeting allowance for not more than two attendances for that day.

Section6.Members of the subcommittees of the Constitution Drafting Committee, members of the subcommittees of the National Legislative Assembly, and members of the subcommittees of the Constitution Drafting Assembly shall receive meeting allowance at the rate of five hundred baht per attendance only for the meetings they attend.

The members under paragraph 1 of a subcommittee shall have the right to receive meeting allowance for one attendance per day only, save where he attends a meeting of another subcommittee on that day also, in which case he shall receive meeting allowance for not more than two attendances for that day.

Section7.When they report themselves for the first time, Members of the National Legislative Assembly or Members of the Constitution Drafting Assembly who reside outside the province where the reporting takes place shall receive reimbursement of the expenses incurred in travelling from the province they reside to the province where the reporting takes place and shall receive reimbursement of the expenses incurred in travelling from the province where the reporting takes place back to the province they reside. In this respect, reimbursement shall only be made in the amount actually incurred.

Once the royal decree convening the National Legislative Assembly or Constitution Drafting Assembly is issued, Members of the National Legislative Assembly or Members of the Constitution Drafting Assembly who reside outside the province where the assembly meets shall receive reimbursement of the expenses incurred in their first travel from the province they reside to the province where the assembly meets, and when the membership of a Member of the National Legislative Assembly or Constitution Drafting Assembly comes to an end, he shall receive reimbursement of the expenses incurred in travelling from the province where the assembly meets back to the province where they reside. In this respect, reimbursement shall only be made in the amount actually incurred.

Section8.Once a meeting of a committee of the National Legislative Assembly or Constitution Drafting Assembly takes place, the members of the committee of the National Legislative Assembly or Constitution Drafting Assembly who reside outside the province where the committee meets shall receive reimbursement of the expenses incurred in travelling from the province they reside to the province where the committee meets, and once the meeting of the committee of the National Legislative Assembly or Constitution Drafting Assembly ends, they shall receive reimbursement of the expenses incurred in travelling from the province where the committee met to the province they reside.

The provisions of paragraph 1 shall not apply to committee members who are Members of the National Legislative Assembly or Constitution Drafting Assembly.

Section9.The President and Vice Presidents of the National Legislative Assembly, President and Vice Presidents of the Constitution Drafting Assembly, holders of positions in the Council for National Security, Members of the Constitution Drafting Assembly, Members of the Constitution Drafting Committee, members of the committees of the National Legislative Assembly, members of the committees of the Constitution Drafting Assembly, and holders of positions in the Constitutional Tribunal shall receive reimbursement of the expenses incurred in travelling to perform their duties and the royal decrees on official travel expenses shall apply mutatis mutandis, in respect of which they shall receive reimbursement at the same rate as that for public servants holding 11th level positions.

As for official travels to foreign countries, the President of the National Legislative Assembly, President of the Constitution Drafting Assembly, President of the Council for National Security, and President of the Constitutional Tribunal shall have the right to receive reimbursement of expenses at the same rate as that for the Prime Minister; the Vice President of the National Legislative Assembly, Vice President of the Constitution Drafting Assembly, Vice President of the Council for National Security, and Vice President of the Constitutional Tribunal shall have the right to receive reimbursement of expenses at the same rate as that for a Deputy Prime Minister; whilst Members of the National Legislative Assembly, Members of the Constitution Drafting Assembly, Members of the Council for National Security, Members of the Constitution Drafting Committee, members of the committees of the National Legislative Assembly, members of the committees of the Constitution Drafting Assembly, and Members of the Constitutional Tribunal shall have the right to receive reimbursement of expenses at the same rate as that for public servants holding 11th level positions.

Section10.The Secretariat General of the Senate shall furnish the President, Vice Presidents, and Members of the National Legislative Assembly with railroad, bus, and airplane passes for them to use in travelling to perform their duties outside the province where the National Legislative Assembly meets.

The Secretariat General of the House of People’s Representatives shall furnish the President, Vice Presidents, and Members of the Constitution Drafting Assembly and Members of the Constitution Drafting Committee with railroad, bus, and airplane passes for them to use in travelling to perform their duties outside the province where the Constitution Drafting Assembly or Committee meets.

Upon having been furnished with a pass according to this section, the President and Vice Presidents of the National Legislative Assembly, President and Vice Presidents of the Constitution Drafting Assembly, Members of the National Legislative Assembly, Members of the Constitution Drafting Assembly, and Members of the Constitution Drafting Committee are no longer entitled to reimbursement of the expenses incurred in travelling to perform their duties according to section 9.

Section11.Requests for payment of the positional allowances, extra allowances, and travel expenses of the President, Vice Presidents, and Members of the National Legislative Assembly, as well as the meeting allowances and travel expenses of members of the committees and subcommittees of the National Legislative Assembly, shall be made to the Secretariat General of the Senate.

Requests for payment of the positional allowances, extra allowances, and travel expenses of the President, Vice Presidents, and Members of the Constitution Drafting Assembly, as well as the remuneration for service of the Members of the Constitution Drafting Committee and the meeting allowances and travel expenses of the Members of the Constitution Drafting Committee, members of the committees of the Constitution Drafting Assembly, members of the subcommittees of the Constitution Drafting Committee, and members of the subcommittees of the Constitution Drafting Assembly, shall be made to the Secretariat General of the House of People’s Representatives.

Requests for payment of the positional allowances, extra allowances, and travel expenses of the President, Vice Presidents, and Members of the Council for National Security shall be made to the Permanent Secretariat to the Ministry of Defence.

Requests for payment of the positional allowances, extra allowances, and travel expenses of the President, Vice Presidents, and Members of the Constitutional Tribunal shall be made to the Office of the Constitutional Court.

Section12.The Prime Minister shall be in charge of the execution of this Royal Decree.

Note: The grounds for promulgation of this Royal Decree are as follows: Whereas section 33 of the Constitution of the Kingdom of Thailand (Interim), 2549 Buddhist Era provides that positional allowances and other remunerative benefits of the Presidents and Vice Presidents of the National Legislative Assembly and Constitution Drafting Assembly, holders of positions in the Council for National Security, Members of the National Legislative Assembly, Members of the Constitution Drafting Assembly, and holders of positions in the Constitutional Tribunal shall be designated by a royal decree, and whereas it is appropriate to designate remuneration and other remunerative benefits for members of legislative committees, it is therefore necessary to enact this Royal Decree.
