Paragraph 1- If one accepts a field from another to plant trees, the owner of the field is deemed to have accepted 10 desolate trees per seah. There are those who say the formula is for 100. Any more than this and we would obligate the renter on the entire amount.

Paragraph 2- In a place where the custom is that one who plants the trees receives half the appreciation and the owner receives the other half, and the renter planted and caused a loss, we appraise half the appreciation that he is owed, we deduct the amount of loss he caused and he would take the rest. Even if the renter made a condition on himself that he if he causes a loss he will not take anything, it is an asmachta and we would only deduct the amount of loss he caused.

Paragraph 3- If the renter planted and caused an appreciation and now wants to terminate, which will require the owner to hire a sharecropper, the owner will hire the sharecropper, who usually takes 1/3 of the appreciation, the owner will take half and not lose anything, the sharecropper will take 1/3 and the remaining 1/6 will go to the original renter because he willingly terminated the arrangement. He cannot, however, terminate without permission of the owner.

Paragraph 4- In a case where the planter takes half the fruits, he would also takes half of the grapes that aged. If a river swamped the field or the wind uprooted the plants, however, would only receive ¼.

Paragraph 5- If the sharecropper claims that he made a condition that he would receive half, and the owner claims he only agreed to give him 1/3, we would follow the local custom.
