BY THE CHAIRMAN OF THE EXECUTIVE COMMISSION

EXECUTIVE ORDER NO. 211

FIXING THE PLACE AND DATE FOR THE FIRST SESSION OF THE FIRST NATIONAL ASSEMBLY AND FOR THE ELECTION OF THE PRESIDENT OF THE REPUBLIC OF THE PHILIPPINES, AND REGULATING THE HOLDING THEREOF.

Pursuant to the authority conferred upon me as Head of the Central Administrative Organization by Order No. 1 in connection with Order No. 3 of the Commander-in-Chief of the Imperial Japanese Forces in the Philippines and in accordance with the provisions of the Constitution of the Republic of the Philippines, it is hereby ordered, upon the recommendation of the Executive Commission, that—

SECTION 1. The First National Assembly shall convene in the Session Hall of the Legislative Building, Manila, at ten o'clock in the morning of September twenty-fifth, nineteen hundred and forty-three. Immediately after its organization it shall proceed to elect the President of the Republic of the Philippines. A majority vote of all the Members shall be necessary to elect the President.


SEC. 2. The election shall be viva voce and the result shall be announced publicly. If the majority necessary for the election of the President is not obtained, the proceedings shall be continued until such majority shall have been obtained. The Assembly shall not adjourn until it shall have elected the President
As soon as voting results in an election, the Speaker shall publicly announce the result, cause the same to be entered on the records of the Assembly and to be certified by the Secretary of the Assembly to the Chairman of the Executive Commission.


SEC. 3. This Executive Order shall take effect upon its approval by the Commander-in-Chief of the Imperial Japanese Forces in the Philippines.

The above proposed Executive Order, approval for which was requested by letter Ex. No. 2431, is hereby duly approved: Provided, however, That the following amendments be made in the text:

Section 1.—"...at 10 o'clock in the morning of September 27, 1943," to read: "...at 10 o'clock in the morning of September 25, 1943."
Section 2.—"The election shall be by secret ballots and the votes cast counted publicly" to read: "The election shall be viva voce and the result shall be announced publicly"; and the wording of the subsequent sentences shall be corrected accordingly.

The HIGHEST COMMANDER OF THE IMPERIAL JAPANESE ARMY IN TEH PHILIPPINES
Manila

YOUR EXCELLENCY:

Upon the recommendation of the Executive Commission, I propose to issue the attached executive order, fixing the place and date for the first session of the First National Assembly and for the election of the President of the Republic of the Philippines, and regulating the holding thereof. This executive order has been prepared to carry out the provision of section 2, Article II of the Constitution of the Republic of the Philippines to the effect that the President of the Republic shall be elected by a majority of all the members of the National Assembly at the place and on the date to be fixed by law.

In accordance with the provisions of paragraph 5 of your Order No. 1 in connection with your Order No. 3, I respectfully request approval of this executive order, a signed copy of which is herewith enclosed.
