Anno xxxiv 8c xxxv He n iuc 1 VIIL C. 1 6. 343 then before fuch of the Lord Treafurer, Chamberlains, Chancellor, and of the fail B 'Vn (hull happen t» be prefent in the faid Court, to bring in and deliver into the faid Court, Etolli u i. !■.;!., cA Parchment, containing in them truly without Omiflion or Concealment, all fuch particular Sums of Mo- ney which he hath levied or lawfully might have levied to his Witting or Knowledge within bu Bailywike, 1 or Parcel of the faid ancient Fermcs, and the other Fcrmes before rehearlcd, making expreii and diflind Mention in the fame Rolls or Schedules, »as near as he or they can or may, of what Perfon, an'l in what Lands and Tenements, and for what Caule the fame particulai Sum •, and every of them, be levied or leviable toward the making of the fame Fcrme, or any of them ; and that after the fame Rolls or Sche- dule, fo delivered, and the particular Sums of Money in them contained, appertaining to their proper Fcrmes, call and rated before the Lord Treafurer, Chambcrlaines, Chancellor and Barons, or before the irons in the Abfence of the Lord Treafurer, Chambcrlaines, or Chancellor for the Time being, or any of them; the fame Lord Treafurer, Chamberlaines, Chancellor, and the faid Barons, or the faioT Ba- rons in the Abfence of the faid Treafurer, Camberlaines 01 Chancellor, or any of them for the Time bo- ing, (hall have full Power and Authority by this Act, to make Allowance, Exoneration, and Deduction in ilu laid open Court, from Time to Time, by their Difcrctions, to every fuch Perfon, in every of the faid Fcrmes, of fo much Money as the faid Fcrmes (hall be mure than the faid Particulars fo apportioned and contained in the laid Rolls or Schedules, do amount unto; and for Reviving and Recovery of fuch Parcels belonging to any of the faid Fermes, or other the Premifies, omitted out of the faid Rolls or Schedules, ami for faving of other the King's ancient Rights and Inheritances, anfwerable in the laid Lxchcquer, whil li be now wrongfully withdrawn, and unjullly withholdcn from his Poficffion ; the Lord Treafurer, Chambcrlaines, Chancellor and Barons of the faid Lxchcquer, or the fame Barons in the Abfence of the faid Treafurer, Chamberlaines and Chancellor, or any of them, fhall from Time to Time award fuch Proccfs, and ufe fuch convenient Ways and Means by Commiffion, or otherwife, according to the Courfe of the faid Exchequer, and further as fhall be deviled by their Difcretion, fo that the King, his Heirs and Succcffors may be truly anfwered of the Blues and Profits of the fame, without other Warrant to be pur- fued and obtained for the PrcmilTes, or any Part thereof; any Eftatute, Aft, Ordinance, or Ufe heretofore to the contrary, had, made or ufed in any wife notwithstanding.
- II. And furthermore, where divers and fundry Sums of Money been refpecled to any Perfons, which
' have been Sheriffs of the faid Counties before this Time, upon their Accounts yelden in the Kings faid
- Court of his Exchequer of the forefaid Ferms and other Vicounties, upon divers Petitions in the faid
1 Court, for fo much as they nor any of them could nor might levy the fame by Virtue of the Summons 1 of the faid Exchequer, for fuch Caufes as the fame late Sheriffs have alledged in their faid Petitions, as ' by the fame Petitions more plainly doth appear :' Be it therefore enacted by the Authority aforefaid, That all and every the faid late Sheriffs, upon their Oaths taken in the faid Courts, that the Caufes al- ledged in the fame Petition be true, and the fame Caufes examined in the fame Court accordingly, be by Virtue of this prefent Act clearly acquitted and difcharged againft the King's Majefty, and his Heirs and SuccclTors for ever, of all and every fuch Sum and Sums of Money, fo not levied nor leviable, put in Re- fpe£t, as is before rehearfed. And thereupon fuch like Procefs to be awarded by the faid Court, and fuch convenient 'Ways and Means by Commiffion and otherwife to be had, according to the Courfe of the faid Exchequer, from Time to Time, as fhall be advifed by the faid Lord Treafurer, Chamberlaines, Chancellor and Barons, or in the Abfence of the faid Lord Treafurer, Chamberlaines or Chancellor, or any of them, by the faid Barons, and by as many of the faid Lord Treafurer, Chamberlaines and Chancellor, as then fliall happen to be there prefent, without either Warrant or Suit in that Behalf to lie had. ' III. And forafmueh as the Sheriffs of the faid Counties for the Time being, fhall fuftain and fupport ' divers Charges, by reafon of their faid Office of Sherifwick, as in executing the King's Writs and Sum- ' mons, and levying all Sums of Money contained in the Extreats within their Counties, and in coming fo I* the Exchequer to make their Prefers and Views of their Accounts, and make Payment of all that fhall ' be due upon every of their Views and Accounts, and other divers Cofts and Charges concerning the fame ' Office of Sherifwick, without having from henceforth any Taille or Tallies of Reward, Portage or other ' Allowance towards their faid Charges. And where alfo divers of the faid Sheriffs heretofore have ufed ' at their own Cofts to bear yearly the Charges of the Expences of the King's Juftices of Affiles, Niji ' Prius, general and fpecial Gaol-deliveries, and Oyer and Determiner, and of their Clerks of Affiles and ' Servants at the fame Seffions, at their coming two Times in the Year, during fuch Time as the faid ' Juftices remain and ferve the King's Highnefs there, without having heretofore any Recompence or Al- r lowance for the fame. And to the Intent that every of the faid Sheriffs for the Time being, may and fhall P hereafter be more able diligently to ferve the King in his or their faid Offices, without taking any uu- ' lawful Exactions of the King's Subjects, and alfo better to make Provifions for the Juftices, and their ' Company in their Circuits, having Aid of the King towards their faid Charges and Expences :' The King's Highnefs, of his Liberality, in Confideration of the Charges, fo to be fuftained by_ the '.aid She- riffs, is contented and pleafed that it be enacted by his Highnefs, with the Affent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the lame, That every of the faid Sheriffs, coming to his Accounts in the faid Exchequer, (hewing a Bill fubferibed with the Hands of the faid Juftices, or of fuch of them as (hall be prefent at the faid Affiles and Seffions, making plain Mention of the Dayes and Time that the faid Juftices did abide or remain in the fame County at the Colls of the faid Sheriffs, in or about the King's faid Affairs and Bufmeffes, (hall have Allowance as well hereof as for other his faid reafonable Cofts, upon his or their Accounts in the laid Exchequer, by the Difcretion of the faid Lord Treafurer, Chamberlaines, Chancellor and Barons, and in the Abfence of the f lid Lord Treafurer, Chamberlaines, Chancellor or any of them, by the faid Barons, and by as many of the faid Lord Treafurer, Chamberlaines and Chancellor, as then fliall happen to be there prefent, by
