' Realm, as well into Scotland, as into other foreign Realms beyond the Sea, many and divers gri ides of Horfes, Geldings and Marcs, which have been thought as well great Occafion, Strength and „„«. Incfs to the Si t':Jl> Men, and other the King's foreign Enemies, having in Pofliffion the !':. lings and Marcs in Time of War to invade this Realm, as alfo a great Decay of the good lire • Horfes and Mares, which before Time hath been within tlib Realm, to the great Detriment and Hin- ' drance of the King's poor Subjects, towards the Defence of this Realm, and other his Dominions:' (2) For Remedy whereof, be it therefore enacted by our Sovereign Lord the King, and by the Commons, in The Pea ftis prefent Parliament aflembled, and by the Authority of the fame, That if any Perfon or Pcrfons, a; 1 the flirt Day of January next coming, do fell, exchange, give, convey or deliver into the Realm of Scotland, s ' u . to the Ul'e of any Scotijh Man, (3) or do cany, give, exchange, fell, fend, convey, or deliver into any other fa Place beyond the Sea, out of this Realm, or the Dominions of the fame, any Horfc, Gelding or Marc, Countries with— tt fpecial Licence therefore to be obtained of the King's Highncfs, or of his Heirs, under the Great out theKiag'i Seal of this Realm, or under the Privy Signet : (4) Or if any Perfon or Pcrfons after the faid firft Day of ^ lc ""- January do fell, exchange, give or deliver to any Scotijh Man within this Realm of England or Wales, the j 3 t] ' c ' ' ' Town of Berwick, or the Marches of the fame, to the Intent to be conveyed into Scotland, any Horfe, + j iC , ,, c . ,. Gelding or Mare, (5) or do convey or carry any Horfc, Mare or Gelding into any foreign Parts beyond the Sea, without like fpecial Licence obtained of the King's Highncfs, or of his Heirs, under the Great Seal or Pi iy Signer, as is aforefaid : (6) That then the lame Perfon and Perfons fo offending contrary to this At£t, (hall lofe and forfeit to our Sovereign Lord and his Heirs, the fame Horfc, Mare or Gelding fo carried and conveyed; (7) and alio fhall lofe and forfeit the Sum of forty Pound, for every fuch Horfc, Gelding or Mare fo to be conveyed and carried in Form aforefaid : Whereof the one Moiety to be to the King, and the other Moiety to him or them that will fue for the fame by Information, Action of Debt or Detinue, in any of the King's Courts of Record ; in which Suit no Wager of Law, Efloin ne Protection lhall be allowed. (8) And that alfo all and every Perfon and Perfons fo offending contrary to this Act, fhall fuller Imprifonment by the Space of one whole Year. II. And be it further enacted by the Authority aforefaid, That it fhall be lawful, as well to the Warden The Wirdens in and Wardens of the Eaft, Weft and Middle Marches for the Time being, in their Warden Courts, as alfo 'heir Count md to all and every the King's Jufticcs of the Peace in every Shire, as well in England as in Wales, in their J"'"™*™ r '"^ Quarter-SciTions, to enquire of all and every Offence or Offences hereafter to be perpetrated, commited or ofienden! done contrary this Act : (z) And that it fhall be lawful to all and every Perfon or Perfons, being the King's Subjects, to a'rreft and imprifon every Scotijh Man, and all and every other Perfon or Perfons, which fhall lead or convey, contrary to the Meaning of this Act, any fuch Horfc, Gelding or Mare, out of this Realm into the faid Realm of Scotland, or into any other foreign Place beyond the Sea, other than fuch Perfons as hereafter fhall have fufficicnt Warrant by or from the King's Highnefs, or his Heirs, under his or their Great Seal or Privy Signet, according to the Meaning of this Act. III. ' "* : the King's Great Seal, to licence any other Perfon or Perfons to carry and convey any Horfes, Marcs or Geldings into Scotland, or into any Parts beyond the Sea: That then it fhall be lawful, as well to all and Angular Perfon and Perfons, having fach Licence under the King's Great Seal or Privy Signet, as to all and eveiy other Perfon and Perfons having Licence in Writing, under the Seal of fuch Perfon or Perfons to whom the King fhall give Authority, Power or Commandment in Form abovefaid, to licence other Per- fon or Perfons to carry or convey any Horfes, Mares or Geldings into Scotland, or into any Parts beyond the Sea, to carry and convey fuch Number of Horfes, Geldings or Mares, or any of them, into Scotland, or into any of the Parts beyond the Sea, as fhall be mentioned in any fuch Licence, as is before fpecified ; any Thing mentioned in this Act to the contrary in any wife notwithstanding. IV. Provided always, and be it enacted by the Authority aforefaid, That this Act, nc any Thing therein e ; • ■ contained^ ftiall in any wife extend to any Perfon or Perfons, which at any Time hereafter {hall carry or : convey any Horfe, Mare or Gelding into Scotland, or into any other foreign Parts beyond the Sea, to fervc ,.. the King in his Wars, with the fame Horfes, Mares or Geldings ; any Thing mentioned in this Act to the ' : *' contrary in any wife notwithflanding.
