D. 1707 all Perfons within their ieveral Bounds, whatever doth appertain to the Office and Truft of a Juflice of Peace, by Virtue of the Laws and Aflis of Parliament made in England heforp the Union, in Relation to and for the Prefervation of the publick Peace. Provided neverthelefs, That in the Seflions of the Peace the Methods of Trial and Judgments {hall be according to Laws and Cuftoms of Scotland. in. Provided, That nothing in this A£t contained ihall be conftrued to alter or infringe any Rights, Liberties, or Privileges heretofore granted to the City of Edinburgh, or to any other Royal Borough, of being Juftices of Peace within their refpeilive Bounds. ' IV. And whereas by an A(5l made in Scotland in the Third Seffion of the fecond Parliament of the ' late King Charles the Second, intituled, Jn A£i concerning the Regidation of the Judicaturies, feveral ' good and wholfome Provifions were made concerning the Juftice Court, and amongft others it was ' thereby enaded. That once a Year Circuit Courts ftiould be kept at the Time and Places in the faid ' A& mentioned :' Now for the better and fpeedier Adminiftration of Juftice, and further Prefervation of the publick Peace in that Part of the Kingdom of Great Britain called Scotland, be it alfo enafted by the. Authority aforefaid, That for the future, twice in the Year, that is to fay, in the R4onths of April or Mj, and in the Month of Ooiober, Circuit Courts fhall be kept in the feveral Places in the faid Aft mentioned, and in Manner and Form as in the faid A£l: contained. V. And for the more uniform and exprefs Method of elefting and returning Members of Parliament, be it likewife further enafted by the Authority aforefaid. That when any Parliament fliall at any Time hereafter be fummoned or called, the forty-five Rcprefentatives of iSw//««^ in the Houfe of Com.mo'ns of ll^^l^l^'^'^^^^ xh&V2.x,mtnt of Great Britain, fhall be elefted and chofen by Authority of the Queen's Writs under the Great Seal of Great Britain, direfted to the feveral Sheriffs and Stewarts of the refpeilive Shires and Stewartries ; and the faid feveral Sheriffs and Stewarts fhall, on Receipt of fuch Writs, forthwith give Notice of the Time of Ele£lion for the Knights or CommiiTioners for their refpeftive Shires or Stewart- ries, and at fuch Time of Election the feveral Freeholders in the refpeftive Shires and Stewartries fliall meet and convene at the Head Burghs of their feveral Shires and Stewartries, and proceed to the Elettioa of their refpeiStive CommiiTioners or Knights for the Shire or Stewartry ; and the Clerks of the faid Meet- ings, immediately after the faid Eleftions are over, fliall refpedlively return the Names of the Perfons e- ledted to the Sheriff or Stewart of the Shire or Stewartry, who fliall annex it to his Writ, and return it with the fame into the Court out of which the Writ iffued : And as to the Manner of Eleftion of the fif- teen Reprefentatives of the Royal Boroughs, the Sheriff of the Shire of Edinburgh fhall, on the Receipt of the Writ directed to him, forthwith diredl: his Precept to the Lord Provofl: of Edinburgh, to caufe a Bur- gefs to be elefled for that City; and on Receipt of fuch Precept, the City of Edinburgh fhall eleiSt their 11 Member, and their common Clerk fhall certify his Name to the Sheriff of Edinburgh, who fhall annex it ' to his Writ, and return it with the fame into the Court from whence the Writ iffued : And as to the other Royal Burghs, divided into fourteen Claffes or Diflricls, the Sheriffs or Stewarts of the feveral Shires and Stewartries, (hall on the Receipt of their feveral V/rits, forthwith direiSt their feveral Precepts to every Royal Borough within their refpeftive Shires or Stewartries, reciting therein the Contents of the Writ, ' and the Date thereof, and commanding them forthwith to eled: each of them a Commiffioner as they ufed formerly to eleft.Commiffioners to the Parliament of Scotland, and to order the faid refpe£fiye Commiffi- oners to meet at the preuding Borough of their refpeftive Diftricl (naming the faid {>refiding Borough) upon the thirtieth Day after the Day of the Te/le of the Writ, unlefs it be upon the Lord's Day, com- monly called Sunday, and then the next Day after, and then to choofe their Burgefs for the Parliament; and the common Clerk of the then prefiding Borough fliall immediately after the Election, return the Name of the Perfon fo eletfted to the Sheriff or Stewart of the Shire or Stewartry wherein fuch prefiding Borough is, who fhall annex it to his Writ, and return it with the fame into the Court from whence the Writ iffued ; and in cafe a Vacancy fliall happen in Time of Parliament, by the Deceafe or legal Incapa- city of any Member, a new Member fliall be ele<5led in his Room, conformable to the Method herein- before appointed; and in cafe fuch Vacancy be of a Reprefentative for any one of the faid fourteen Claffes or Diftridts of the faid Royal Boroughs, that Borough which prefided at the Ele<ftion of the deceafed or - difabled Member, fhall be the prefiding Borough at fuch new Election. VI. Provided always. That upon the iffuing of Writs of Summons for the electing of a Parliament, if any Shire or Stewartry wherein a Royal Borough is, hath not then a Turn or Right to eleft a Commif- fioner, or Knight of the Shire or Stewartry for that Parliament, that then it fhall be omitted out of the Writ direfted to fuch Sheriff or Stewart, to caufe a Knight, Commiffioner for that Shire or Stewartry,. to be elefted for that Parliament. , CAP.
